Can Neighbours Permanently Keep Footwear in Common Passage/Emergency Access Area Outside Flats?
Need a legal/practical perspective on this apartment society issue.
My neighbours keep 4–5 pairs of footwear outside their flat permanently in the common passage area, right outside our home. This passage also leads to the terrace and functions as the only access route in that direction.
This has been going on continuously, and despite raising it with the RWA/association, no action has been taken.
My concerns are:
- Can residents legally occupy common areas outside their flat for personal storage/use?
- If the passage leads to the terrace/emergency access area, can this be treated as a fire safety or emergency exit obstruction issue?
- Are there any apartment ownership rules, municipal guidelines, or fire norms that apply here?
- What practical/legal steps can be taken if the association refuses to intervene?
To clarify, this is not about a one-off pair of shoes kept temporarily outside, but a permanent everyday occupation of common space.
Would appreciate guidance from people familiar with apartment laws/RWA matters in India.
