Signed an apartment lease today in OKC and immediately found no water, 110°F+ temperature, roaches & electrical issues, what would you do?
My roommate and I signed a lease and received the keys to an apartment in Oklahoma City today. We relocated from out of state for school and discovered multiple serious problems basically as soon as we moved in.
There was no running water at all. Water is landlord-provided under our lease. We immediately called maintenance and were told that they had not been notified/instructed to turn the water on before our move-in. They were unable to get it resolved tonight.
We also discovered:
- The A/C wasn’t cooling and the temperature inside reached over 110°F.
- When we turned the A/C on, a very strong and unpleasant smell started circulating throughout the apartment.
- The kitchen sink is completely clogged and won’t drain at all.
- We found roaches underneath the stove.
- Multiple electrical outlets appear to be malfunctioning/overheating when we plug phone chargers into them.
The heat became so bad that we started feeling physically sick and ultimately had to leave and get a hotel for the night.
We took photos/videos of everything and sent management written notice the same day we received possession.
The lease also has provisions potentially charging tenants for the first $50 of certain maintenance/service calls and making tenants responsible for certain plumbing issues. It also says the landlord handles pest infestations reported within the first 30 days, which is why we documented the roaches immediately on day one.
We’re not trying to just abandon the lease. Our concern is that this was the condition of the apartment when it was handed over to us on the very first day.
We relocated a long distance for school, classes start very soon, and this has already been extremely stressful. We don’t really have the time to spend the beginning of school dealing with major water, A/C, electrical, plumbing, odor, and pest problems in a place we just moved into.
We have asked management about an appropriate resolution, including a mutual release from the lease without penalty, because at this point we don’t feel comfortable proceeding with the tenancy.
For anyone familiar with Oklahoma landlord-tenant law or who has dealt with something similar: how would you handle this? Do these day-one conditions give us reasonable grounds to push for a penalty-free release? And if management says they’ll repair everything tomorrow, how does that affect our options given that the apartment was delivered to us in this condition?
