Understanding USCIS RFEs and Denials on I-140 Petitions

My I-140 was just denied after waiting almost 23 months for a decision. Nearly two years of checking case updates, staying hopeful, trying to be patient, and putting major life plans on hold, only to end up with a denial in the end.

What makes it more frustrating is the agency that I have a contract with to process my papers have not given me an answer what to do next. I can't e-mai the USCIS on my own, I have to depend on the agency that is bottling up my journey. My question is, is it the agency that messed up the process or is it a fault on my part? If the case had issues, why let it sit for that long? The uncertainty, stress, and emotional toll of waiting that long is something only people going through this process can truly understand.

Now it feels like all that time was wasted, and I’m left trying to figure out what comes next.should I start a fresh or where should I go?. Immigration processing delays are not just numbers on a website, they affect real people, careers, families, and futures.

According to ICE Director, authorities have investigated cases involving visa fraud, fake employment records, and other alleged abuses tied to some individuals using the student visa system improperly. He also said past investigations uncovered students reporting jobs at companies or worksites that could not be verified.

He further claimed that the OPT program has expanded far beyond its original scope, with authorities identifying thousands of students linked to employers considered suspicious. Investigators reportedly visited multiple worksites across several states and found cases where businesses appeared inactive, shared questionable addresses, or could not confirm employment claims. He said the investigations are ongoing and that broader oversight efforts are being expanded nationwide.

Bier cited ICE and DHS data showing that 72% of immigrants booked into ICE custody reportedly had no criminal conviction, while only 6% had violent criminal convictions.

Bier also claimed DHS internal threat assessments classified most detainees as “not a threat,” arguing that enforcement actions are increasingly affecting workers, legal immigrants, and even U.S. citizens. He further accused USCIS leadership under Joseph Edlow of slowing or halting green card processing, which he said could leave some immigrants out of status and vulnerable to arrest. Adjustment Of Status Filling Charts: Which Chart To Use In June Visa Bulletin

June Visa Bulletin is out and as per the USCIS they usually communicate after 1 week of the release of Visa Bulletin.

They will state whether to use the Dates for Filing chart or the Final Action Dates chart to determine when to file your adjustment of status application.

For those doing AOS you will wait a little longer after the release of Visa Bulletin to know your fate.

Current Since March-April Visa Bulletin but Still Waiting on I-140 Approval; How Are You Handling It?

Some 2-3 months ago, we had massive movement in Visa Bulletin,in fact it got many by surprise and Many of us were happy and didn't know how to handle the surprise movement in dates. Little did we know that after the massive movement, I-140 will go to sleep and assume like it doesn't know dates moved and many employment-based applicants became current in the March - April Visa Bulletin.

For those who have already been current since March-April and are still waiting on I-140 approval, how are you handling the delay? Has anyone had success expediting, contacting USCIS, or receiving updates from Emma or service requests?
