Gen 3 battery issues

Why isn’t Oura required to recall the Gen 3 ring if battery issues are as common as they seem?

For context, my husband has the Gen 3 (2 years old) and the battery inside of it recently started to swell out of the ring. It no longer fit on his charger or his finger and he can no longer use it. When I researched this online it seemed like Oura has had quite a few people have this issue and they usually had to provide replacements.

Faulty lithium batteries can pose a huge risk - between causing harm to your fingers and randomly igniting a hard to put out fire. When my husband contacted Oura about this, he had to talk to over six people before they finally offered him a replacement ring. It seems like a lithium battery issue is serious, so why haven’t these been recalled or the problem taken more seriously? I understand being outside of warranty for normal wear & tear/faulty devices, but if a device no longer functions in a safe manor (after only 2 years!!) it seems like the company should be liable for that.
