Divorcing in Texas. Is mediation realistic if we disagree about selling our house?
My wife and I are heading toward divorce after 12 years and the house is becoming the sticking point. We have around 240k in equity and two kids. I want to sell, split whatever we walk away with and make a clean break. She wants to refinance and buy out my share because she doesn't want the kids to move.
We aren't fighting over furniture or trying to destroy each other financially. The problem is that neither of us agrees on what a fair buyout looks like, especially after factoring in the mortgage and improvements we've made. I'd rather spend money reaching an agreement than spend it fighting in court. Has anyone around here handled something like this through divorce mediation? At what point does a disagreement over the house make having separate attorneys the smarter option?
