Is "Upright Privet" (Ligustrum vulgare “swift”) invasive? Do I need to return this to Gerten's?

I picked up an "Upright Privet" (Ligustrum vulgare “swift”) from Gerten's yesterday, I've dug the hole and was just about to plant it when I looked it up just to find out that it is considered invasive.

I'm seeing conflicting statements on whether or not it spreads here in Minnesota and apparently this is less invasive than "Chinese Privet".

Can anyone provide any insights?

Should I not plant this and return it? That's almost an hour drive for me...

Really disappointed that they are selling it if so.

Tree or tree shape plants that won't crack a concrete patio in the next 20+ years?

We had a stamped concrete patio put in last summer, it was very expensive for us and a big decision. Overall we're really happy with it but I really regret not leaving a bigger spot for a shade tree.

As is, we have a 3' perimeter to work with. It's concrete patio on one side a fence on the other (the fence lets a lot of sun through but is a physical barrier for lower branches).

I'm wondering if anyone has suggestions for what kind of trees will first and foremost not crack the patio in the next 2+ decades and secondly do well in a spot like this?

I'm in zone 4b and there are 2 spots I'd like to put trees in, one is part shade (shade AM, sun PM) the other is full sun. Again both have a 3 foot space to be planted.
