 FORMAL COMPLAINT AND LEGAL NOTICE – Systemic Examination Paper Leaks, May/June 2026 AS Level Series

I write to you as a candidate enrolled in the Cambridge AS Level May/June 2026 examination series, with deep concern and formal objection regarding the gross negligence displayed by Cambridge Assessment International Education (CAIE) in safeguarding the integrity of this examination season.

It has come to my attention — and is widely documented — that multiple AS Level examination papers have been leaked prior to their scheduled sitting dates. Of specific and immediate concern are the following:

  1. Paper 9709/12 (Mathematics – Pure Mathematics 1): This paper was leaked prior to the examination, resulting in CAIE itself announcing a mandatory retake/resit scheduled for 9 June 2026. This constitutes a formal admission by CAIE that the integrity of this paper was irreparably compromised.

  2. Paper 9709/52 (Mathematics – Probability & Statistics 2): This paper was circulated and accessible to candidates approximately two to three hours before the scheduled examination time, providing an unlawful and unconscionable advantage to those who obtained it.

These are not isolated incidents but form part of a pattern of systemic security failures during the current examination series, which your organisation has a legal and contractual duty to prevent.

LEGAL BASIS FOR THIS COMPLAINT

CAIE's failure to secure examination materials exposes it to liability under multiple legal frameworks, including but not limited to:

a) Breach of Contract: Candidates, schools, and parents enter into a contractual relationship with CAIE upon registration and payment of examination fees. CAIE is contractually obligated to administer examinations fairly and securely. The leaks constitute a material breach of this contract, for which affected candidates are entitled to seek remedies including refund of fees and damages for consequential loss (e.g., wasted preparation costs, tuition fees, and opportunity costs).

b) Negligence (Tort Law): CAIE owes a duty of care to all registered candidates to ensure a fair and secure examination environment. The repeated leaks in this series demonstrate a clear breach of that duty of care. Candidates who did not have access to leaked papers have suffered foreseeable harm — academic disadvantage, psychological distress, and potential damage to university admissions prospects — as a direct result of CAIE's negligence.

c) Breach of Consumer Protection Laws: In jurisdictions where applicable (including under the UK Consumer Rights Act 2015 and equivalent consumer protection legislation in candidate countries), CAIE's failure to deliver a fair examination service constitutes a failure to provide services with reasonable care and skill.

d) Violation of Equal Opportunity and Educational Fairness: The leaks create a demonstrably unequal playing field. Candidates who accessed leaked papers gained an unlawful advantage, directly violating the principles of equal opportunity that underpin internationally recognised qualifications. This may constitute grounds for complaints to national education regulators and accreditation bodies in each affected country.

e) Data and Security Obligations: Depending on applicable jurisdiction, CAIE may also face scrutiny under data protection and information security regulations for failures in its content management and distribution systems.

HARM SUFFERED

I wish to make clear the tangible harm caused by these failures:

- Severe psychological distress and anxiety caused by uncertainty over whether examinations sat were fair, and whether results will be valid;
- Significant time, financial, and emotional investment in preparation that has been rendered meaningless for compromised papers;
- Uncertainty surrounding university conditional offers and progression, which are time-sensitive and cannot simply be paused while CAIE resolves its internal failures;
- The burden of a mandatory resit (9709/12) imposed on candidates through no fault of their own, requiring additional preparation time during an already demanding examination period.

FORMAL DEMANDS

I hereby formally demand that CAIE:

  1. Issue an immediate, transparent public statement detailing the full extent of paper leaks identified across the May/June 2026 series;

  2. Provide, within 14 days of receipt of this notice, a written framework outlining the specific security measures being implemented to prevent further leaks for the remainder of this examination series;

  3. Confirm the measures being taken to ensure fairness in grading and results for all candidates affected by compromised papers, including whether grade boundaries will be adjusted or results annulled;

  4. Provide a formal remediation plan for affected candidates, including options for full fee refunds, complimentary resit registration, and/or other appropriate compensation;

  5. Cooperate fully with any investigation by national education regulators, government bodies, and accreditation authorities in affected countries.

Failure to respond substantively within 14 days of the date of this letter will leave me with no option but to:

- File formal complaints with the UK Office of Qualifications and Examinations Regulation (Ofqual) and equivalent national regulatory bodies;
- Refer the matter to consumer protection authorities;
- Seek legal counsel to pursue civil claims for breach of contract, negligence, and damages;
- Escalate the matter to the mediae and relevant parliamentary or governmental bodies.

FURTHERMORE — AND THIS IS NOT MADE LIGHTLY — should CAIE fail to comply with the above demands or provide no meaningful response within the stipulated timeframe, the affected student body in Pakistan reserves the right to exercise its constitutional right to peaceful protest. We will organise and conduct lawful demonstrations at CAIE's Karachi offices as well as at examination centres across the city. This is not a threat of disruption — it is a declaration of our intent to make the extent of student grievance visible to the public, the press, and the international academic community. Pakistani students represent a significant portion of CAIE's global candidature, and we will not be silenced in the face of institutional negligence that directly harms our futures.

I trust CAIE will treat this matter with the urgency and seriousness it demands. The credibility of your qualifications — and the futures of thousands of candidates worldwide — depend on it.
