Job offer being revoked because my military orders got extended — is this legal?
Hey everyone, I’m looking for some advice because I’m pretty stressed about this situation.
I recently got hired for a new job. I received and accepted the offer letter, completed all of the onboarding paperwork, and was preparing to start. The company was aware that I’m in the military and currently on orders.
The issue is that my military orders were unexpectedly extended, completely out of my control. After informing the employer, they’re now telling me they may take away the job offer because I can’t start on the original date anymore.
I’m trying to understand whether this is legal under military employment protections like USERRA, especially since they already hired me and knew about my military status beforehand.
I’m not trying to cause problems for the company — I just don’t want to lose an opportunity over something I legally have no control over.
Has anyone dealt with something similar, or knows whether USERRA protections apply in this situation before the actual start date? Any advice would really help.
