Another Transfer Case Post - advice appreciated

Hi all, my vehicle is a 2022 X5 45e xDrive with 68,720 miles on the odometer, broken down into 42,434 on electric and just 26,286 on the combustion engine.

Been having the slip/studder of the transfer case accelerating and turning at low speeds, especially when the car isn’t warmed up.  This has been going on for quite some time, I’m guessing around 10,000 miles.  Around 4,000 miles ago I had the fluid replaced but that did not resolve the problem.

I’m aware of the class action and filed a complaint with the NHTSA last week to help boost the pending case and push towards a general resolution.

In the meantime, I have a quote from an independent and trusted shop to replace the TC with a remanufactured TC for about $3,300.  He told me that before I do that, I should contact the dealers and see what they’re willing to do.  Has anyone had luck getting BMW and/or a dealer to acknowledge the problem and step up to the plate to remedy?  Any advice?
