What recourse do I have if I’m locked out of my mobile banking account for depositing a fraudulent check that they allowed to go through?
I got a political email with a check that seemed legitimate enough, for 2,000$, to at the very least attempt to deposit in my mobile app. They hold funds for 50$ checks from my grandmother for two whole days so I thought surely the app will instantly pick up if it’s fraud. After a day I saw 1000$ from it enter the account, and didn’t spend any of it. About a day or two later I woke up and eventually tried to open the app but I was locked out of my account. Just got off the phone to find that I can’t come in to get it fixed, can’t log in to check my balances, I can’t even deposit a check in my account.
The convo with the lady went as you’d expect for the first little bit explaining the issue to her and then verifying my identity and waiting on hold. I asked at one point about how their app didn’t catch it and mentioned specifically that it says it verifies the checks before it allows access.
The lady said “yes, our system didn’t catch it this time” almost word for word admitting blame (at least I think this is legally admitting it). And she also mentioned at one point that part of what prevented me from being able to get in was that there was fraud on another thing from July of this year. After being on hold for that as well I found out the app just couldn’t read the check and I had to redeposit it, no fraud.
Do I have any route to solve this legally? Or did putting faith in the app, even if it tells me it checks to verify them, end up fucking me?
