Utah: No custody order in place, can I decline informal visitation?
Utah question.
My daughter’s father and I were never married. He signed a Voluntary Declaration of Paternity at birth and is listed on the birth certificate. Our daughter is 4 months old. There is an ORS child support case due to TANF benefits, but no court order addressing custody or parent-time.
I have been her primary caregiver since birth and support her having a relationship with her father. However, I no longer wish to arrange informal visitation and would prefer parenting time be established through a court order.
I am not seeking to permanently prevent contact. I want to understand my legal rights and whether I should file for custody and parent-time orders myself.
In Utah, can I legally decline informal visitation and require her father to obtain a court order for parent-time when no custody or parent-time order exists, and could that decision negatively affect me in a future custody case?
