Getting killed by terrible plea deal? Could use some perspective
First DWI. No criminal history. 40 yo male. Tarrant County, TX, which is known for being hard on DWIs (to my knowledge no PTI, and just generally tough on them all around). I was pulled over for getting in the turn lane too early. I told them I'd had 2-3 beers, was coming from a bar (mistake, I know). I did the FSTs (ok, some awkwardness). I think they have my bar tab info, which shows many drinks purchased. Refused breath, blood and they got a warrant. BAC tested at .143 several hours after my arrest.
I was initially offered 22 months probation. Through prosector changes, this offer has not budged. I've now sat in court dockets 5 times watching 10s of DWIs get taken care of before my judge, and I've yet to see anyone get a plea deal as bad as mine for a 1st time DWI. Many with Misdemeanor A, 2nd, 3rd, and aggravated DWIs - of all ages and backgrounds - are getting much better deals. In fact, I'm not sure I've seen any DWI of any nature or background get a worse deal.
I'm just looking for some context, in the absence of data on where my offer lies on the "getting screwed" scale - am I wrong that I am getting pretty much as bad of a deal as possible? Might I have pissed someone off and this is some sort of retribution? (e.g. told officer the blood test would make me throw up, and sure enough it did... I usually pass out but this was longer than most blood draws. Also made them go get a warrant for my blood in the wee hours of the night).
Most recently the prosector told the judge (as part of some procedural stuff) that they wouldn't change the plea deal even if the blood was not admitted as evidence... that was absolutely wild to me. The judge seems inclined to believe this, as "often" the prosecution admits they would change the deal if what is likely the most important piece of evidence is not available.
So, are they just for any number of reasons deciding to maximally screw me worse than anyone/anywhere else in the country? Or am I off on my understanding here somehow?
Edit - am looking for advice as well as just corroboration that I’m on or off base that this is a poor deal for my situation (as I’ve generally described it, and understanding there are nuances).
