A new survey in Arizona

Purchased former model home, about 20 years old, 5 previous owners, in AZ. 13 years ago. New neighbor insisted part of our fence on his property. He hired a surveyor and that survey differs from GIF. 3" of the tip of our fence where the side fence joins the front fence is on his property, the rest is not. He is demanding that we move the fence. Fence company complies with GIF when fence installed, approved by County, approved by HOA. We closed with a Title Company and realtors, not uncommon in AZ. I do realize that we have a claim to that 3" because we have maintained it for 12 years. Anyone have any experience with anything like this? (It throws off the surveys of the homes running alongside us, also by 3". HOA, of course, doesn't know.)

Photos taken with a telephoto lens from a golf course [SFH] [AZ]

Our property is on a golf course and is fenced (with the "usual" golf course tubular fencing). We have received an HOA violation for a "bed headboard" with vines growing on it, something which is classified as "trash." It has been in place for over 6 years. Our side yard is fairly large with a picnic table and umbrella and multiple hanging and basket plants. The photo which was provided with the notice was taken from the golf course with a telephoto lens. I am very frequently in that side yard (which has a fence and netting and plants along the fence) wearing a bathing suit. We entertain in that side yard. We have windows along the back of our house. I feel like my privacy has been violated and, again, the photo provided was taken with a telephoto lens! The golf course is NOT affiliated with the HOA. We are fairly certain we will need to get legal counsel, but any thoughts?

The HOA is on the warpath against everyone. Their "inspector" is "notifying and fining people whose dogs bark for more than 10 consecutive minutes. I haven't been noticed/fined but a neighbor has and asked me if I could help her with "what is the policy?" It's very difficult to disprove that your dog barked for 10 consecutive minutes, for example, two weeks ago Thursday. I asked the management company where that appears in the CC&Rs and she said "It was discussed at last week's meeting, but I was not present." (?) The minutes are currently three months in arrears. I scanned previous minutes and found a February 2019 statement that dogs barking are an enforcement issue, not an HOA issue, and residents should call the Sheriff's Department, not the HOA - BUT the Board Minutes then state "But WE have had two difficult dogs violating the sound restrictions removed." I asked her about the "we." It's HOA's responsibility or it's not. Her response? "The policies adopted by the board have to be congruent with the CC&R's." I wrote back that I would like the CC&R language as well as when and if it was changed. Waiting for an answer. It's sort of like Let's Make a Deal. Pick a door! Congruent is a big word for someone I suspect has to leave a trail of bread crumbs to find her way back from lunch. Just another example of an HOA that doesn't have a clue.

I got a notice from my HOA that lawn art on my property must be removed, and I have 14 days from the notice to remove it. (Another Board approved the lawn art about 6 years ago.) The inspection date was March 18th (or so they say), the same date as the violation notice. The postmark on the notice is March 30th. The Post Office delivered the notice on April 1st. The date by which the correction must be made is also April 1, 14 days from the date of the notice. I questioned where the notice had been from the date of the writing (March 18) to the postmark (March 30). Board will "schedule a meeting with me" but in the meantime has fined me for not removing the lawn art. The CC&Rs do give the date for removal as "14 days from the notice." I have filed a protest, but I am fairly sure that the CC&Rs will prevail. Ridiculous.
