Curious to know if there’s any similar case in Texas. Partner and I have been together for a year and half. She’s been divorced for a few years with two elementary aged kids. Her and the ex lived on the same street for years, 50/50 custody. The ex wanted the geo restriction to be a single elementary school zone but they wouldn’t let it be that small so they settled on the school district. They put some language in the education section that said the kids would attend this particular public elementary school. She has right to set primary address within the entire school district per the geo restriction which lifts if the other parent moves out of the district, which he did. The order also says that both parents have to ensure the kids enrollment in that elementary school and feeder middle and high schools. Obviously written to ensure both parents stayed put and obviously impossible to effectuate if neither parent lives in the school district.

He got remarried and couldn’t live with his new wife in the current school district (and couldn’t afford the size home that he needed) so he moved about 11 miles away, just outside of it into another school district. Now we are trying to find a place to live and her immediate area is too expensive. We are looking to stay as close as possible and still have top rated schools, good home value, and a safer area, which will likely require about a 20 mile or so move. Her ex is putting up a huge fight. Says the geo restriction is irrelevant and the school section means she can’t move out of that 2 square mile area even though he can. When he first moved he encouraged her to move where he moved though, which would have required a school change. He just wants everything to be convenient for him. Seems like a big time narc.

Is there any precedent for a situation like this? Has anyone been through this? This isn’t changing a georestrcition because the restriction has already lifted. This is about whether or not the duty to ensure enrollment, assigned to both parents, should fall solely on the parent who sets the primary address? This is the whole point of the georestriction with lift language. Appreciate any feedback in advance!
