Currently awaiting for the two cases on my 13 year old against her father to be closed. She had siblings witness the two assaults, I had seen bruising, filed a police report but the bruises had healed between the actual event and CPS visit.

Same father several years ago had a case where the allegations of abuse were sustained with a different child.

I‘m not sure what the difference was other than the visible bruises were documented at that time.I was the only witness as the children were too young.

DVRO hearing is coming up and I am hopeful the investigation will give some weight to the seriousness of the situation but very anxious it’s simply not enough documentation.

I’m trying to better understand how schools are expected to handle restraining orders involving minor children, and I’m hoping to get perspective from others with experience in this area.

In our situation, there have now been multiple school events involving a restraining order that requires a parent to stay 100 yards away from a protected child:

  • At one outdoor event, law enforcement on scene described the situation as a “legal grey area” and did not require the parent to leave. Citing restrained parent was at event with other non protected children who are also students at school.
  • At a separate indoor event, held in an enclosed multipurpose room, the principal met in advance with the restrained parent and allowed them to attend. Using the same justification as before. This was done without notifying the custodial parent, or remove child to honor the order and in a setting where maintaining a 100-yard distance was not realistically possible.

 

The decision appears to have been based on assurances that there would be no interaction or disturbance, rather than on whether the distance requirement itself could be met.

This raises some broader questions:

  • When a restraining order requires a fixed physical distance from a minor, is that requirement dependent on behavior or intent?
  • In enclosed or limited spaces where that distance cannot be maintained, how is compliance supposed to work?
  • What responsibility do schools have to prevent situations where a court order becomes effectively impossible to follow?
  • What role should custodial parents have in advance planning when these situations arise?

This is not about assigning blame, but understanding how these situations are handled in practice and how to ensure that court ordered protections for children are meaningfully upheld.

If anyone has any insight I would appreciate hearing how this is typically approached.
