Need advice. 2nd DUI in California. Realistically how much jail time?

Posting for a friend who’s extremely anxious and trying to prepare for worst-case outcomes. He had 2nd DUI in Santa Barbara County w/in 10 year probation and w/ refusal and possible .15 BAC but currently he's still waiting for bloodwork results. He will have his next hearing in 3rd week of July. Any idea how much jail time he'll probably get?

  • misdemeanor DUI charges (VC 23152(a) + 23152(b))
  • prior DUI from 2018
  • alleged BAC .15% or higher
  • alleged refusal of chemical test after arrest
  • police eventually got a warrant blood draw
  • officers reported slurred speech, unsteady gait, etc.
  • he was apparently driving without a front tire and creating sparks/smoke
  • no accident injuries involved

He sought legal advice and lawyer said the evidence is strong and defenses may be limited. He’s terrified about possible jail time and how this could affect his job, housing and pets.

  • Do people sometimes get work release/home detention instead?
  • How disruptive is this usually to employment?
  • After serving time, how hard was it for you to rebuild your life and find or keep jobs?

Please kindly share how did you prepare before serving time in jail?
He knows he messed up and is already spiraling mentally, so I’m also hoping to hear from people who got through something similar and eventually stabilized their life again. Encouraging but realistic advice would really help right now. Thank you so much!
