Being taken to small claims, it feels wrong :/

My younger brother had died after someone had hit him at a stop sign. He was on his motorcycle and basically flew off. It's distressing that I have to remember with what's happening. It's hardly been more than a year. Anyway the guy who had hit him is taking us to small claims because his car... took damage. I don't know who to turn to, we're a low income family and also hardly have any family that are kind or keep contact with.
The one con is he may have been tipsy when he was riding back home, they said he was but we never got the results back.
Do you think ...he has the right to take money after I lost practically the only family I have? What can I do from here.. do I also have a right to fight it?
