Has anyone gone to small claims court over a Diminished Value Claim with USAA?

Earlier this year my 2026 vehicle was rear-ended. The other party had USAA and they took 100% responsibility. Repairs were quite a few thousand dollars.

While USAA was doing their DV calculations, I reached out to a few third-party companies for free estimates on what I should be receiving for a DV claim. Based on the repairs, they all said around $5,000-6,000. But, they did specify that USAA does not negotiate their DV value and you have to go to small claims court to make up the difference when USAA inevitably low-balls you. They did specify that USAA almost always settles once the suit has been filed.

I just got the call for my DV claim and USAA is only going to provide $1,000.

So my question is, has anyone gone through this process and did small claims court actually help get you the rest you were owed?

USAA, Auto Diminished Value Claim, and Small Claims Court

I have a new 2026 vehicle and was rear-ended a couple months ago. The other party was 100% at-fault and his insurance (USAA) took full responsibility.

The car is repaired and I'm in the DV claim stage. While waiting for USAA to get back to me, I got a free estimate from a third-party company that works in the DV space. They said I should get $5000-6000, but they said USAA does not negotiate after they provide their number.

The company said I would have to go to small claims court against the other driver the remainder, but that USAA almost always settles once the suit gets filed.

Does anyone have experience with USAA and DV claims that resulted in them going to small claims court?
