Can I Re-Open an Old Divorce?

I got divorced 10 years ago.

My at the time husband and I had been separated for a couple of years- not legally separated- and at the end of our marriage my husband had gotten into an accident at work.

My ex husband is whom filed for divorce.

During the early stages of the Divorce proceedings, a private investigator contacted me asking me some questions about my husband.

It turns out that my ex had received close to a million dollar in a personal injury settlement and that the person sued had to pay some of that money out of her own pocket, past what the insurance had covered, and she had hired the investigator to see if there was fraud involved.

During the divorce proceedings, my ex husband was turning in financial documents, claiming he was on workers comp, had to pay for his (not mine) minor son, had credit card debt, and had received no settlement.

Later as he turned in the workers comp paper work, he also turned in a document from a lawyer stating that yes he was about to receive a settlement, but that it was solely for "pain and suffering", nothing else.

Being in New York State, this automatically ment that i could receive nothing from his settlement money.

I received nothing in the divorce.

Last summer, 9 years later, I was at the court house looking up my divorce case because I was looking for the name of a lawyer, and I decided to also look up my ex husbands personal injury case- it was also handled in the same county.

As i was scrolling in the courts files, looking inside the case, I noticed documents that looked very familiar, yet slightly different as I looked closer: it was the documents from the settlement agreement that my ex had turned in in the matrimonial case: they had different dates on them than they did in thr divorce case. They also had different break down. I did nog see a mention of the full amount being for "pain and sufferering".

What I did see was that hos case had been paid out before and during the divorce proceedings. Not after.

The documents my ex submitted to divorce Court were forged.

The divorce was decided upon-financially- based upon wrong information.

Can I re-open the divorce case today and request to have the financials recalculated and possibly get compensated for the amount I could/should have been compensated for 10 years ago?

Does this sound shady or is it me?

I filed a suit against against a former employer. A wage and tips suit. I worked in a night club and I didn't get my tips, instead I had to tip out to work etc etc.

The case has been pending for about 4 years because the owners of the establishment where I used to work got hit with a bunch of criminal charges, including tax fraud, selling alcohol without a licence, money laundering and God only knows what else.

During the criminal proceedings my case got placed on hold. It took several years.

For about a year now my case has been back on the calendar.

My lawyer has been telling me that I have to show proof that I actually worked there because as it is there are no records that I did (*I worked there for 5 years)

He has been asking me to provide a list of witnesses and any correspondence that I may have between me abd any managers at the establishment, and any and all information that could be helpful to establish that I worked there.

Because I stopped working there in 2020 when Covid started, it has been hard for me to locate text messages on old phones from that period of time. I keep my old phones but I have them put away in a box that is hard to access- inside a crowded storage unit.

Meanwhile I have provided tax return documents for several years as well as unemployment records showing the establishments name and address.

2 days ago my lawyer emailed me an 8 pages ling document asking me to fill it out and return it to him.

The document was a very detailed questionnaire asking for direct dates of when I worked, how many hours, what made me actually remember this etc.

Also I am being asked for a longer more detailed list of witnesses- which is not so easy to get because I dont live in the area where thos establishment is located and I used to commute 90 minutes each way to get there.- and also I stopped working there 6 years ago.

I have told my lawyer that I so have my old cellohone and I will be able to get more information once I power then up, yet hes asking me for stuff like my employment history dating back as far as 6 years before I started working at this place.

I am starting to feel a weird vibe, wondering silently why my tax and unemployment documents seem to be completely ignored and why old text messages seem to triumph actual government documents.

I am feeling like there is suddenly this huge burden of proof placed onto me that maybe shouldn't be there, and that my lawyer is not really believing me, but believing the defendant.

Is any of this smelling shady or is it me?

HPD complaint for non processed Appeal

I got rejected a few weeks ago based upon an error.

I appealed but never received the official notice of appeal.

Instead the person whom rejected me told me that my appeal was accepted and approved.

After that? Crickets.

I am being told that my file is under review. Umm...was it not already reviewed when the rejection happened?

Or is this completely unlike how the legal system works, and so reviewing the same file multiple times is permitted, generating several decisions on the exact same file?

I want to contact HPD to seek clarification on this. Because this could be pending until summer of 2056, and by then I'm pretty sure that the 25 years tax credit program of this particular building will be done.

Does anyone have a direct email or phone number to the Affordable housing division at HPD? The email address that I thought I had is inaccurate.

Appeal Not Processed- Instead Re-Start From Scratch

I received a rejection notice for a re-rental about 3 weeks ago.

They made an error and did not want to accept my 12 months or rent receipts history and just went ahead abd performed a credit check without my consent. Based upon the credit check I was rejected. They claimed my debt was above $5k and that that is not allowed.

I appealed. In my appeal I used the Marketing Handbook and wrote a thorough defense asking them to reverse their decision.

I never heard back from the appeal department.

I reached out several times for a status update. Crickets.

Last week I finally reached out to the original email address, to the people whom had denied me and whose decision I am appealing.

They replied.

They asked that I submit a sublease agreement to support my rent receipts because I rent ftom a room mate and not a property owner.

I submitted the document as per their request.

After receiving it, they are now preparing to send me a list of other documents that they want from me. As if I wasn't approved already.

All my income verification was approved. Everything was approved. I got rejected at the very end when I submitted rent receipts in lieu of a credit check. Everything else was approved. The package to HPD was signed. Everything was ready, except this last step.

My appeal has not answered. No yes no no.

So, how are they allowed yo start processing my application again, as if nothing had ever happened and they never issued a rejection letter and I didn't appeal that same rejection?

This, to me, sounds like they are not at all following the process. It sounds like they want to back track everything and find a new thing to deny me on.

And aren't they supposed to wait for the appeal to be decided upon first, before asking for any other documents from me?

I am starting to think that the appeal goes to the same people as the original application.

Does anyone have experience with a scenario like this?

Do you need a lease in your own name?

Do you need a lease in your own name to show rent receipts or can you show rent receipts from a room mate who is the official lease holder if you want to opt out if a credit check?

This marketing agency seems to think that you need to rent directly from an owner, not from a room mate?

Does anyone have experience with this or have information as to how the Marketing Handbook views this?

How Long Can An Appeal On A Rejection Notice Pend?

I got rejected based upon ( in my opinion as well as according to the guidelines outlined in the Marketing Handbook) errors.

I was applying to a re-rental that was not advertised on Housing Connect.

I had 10 business days to Appeal. I sent my appeal-via email to the address provided- in on day 8 out of 10.

It has now been almost 2 full weeks and no reply.

I reached out 3 days ago for a status update. Still no reply.

What is the longest that an appeal can stay pending?

I dont see a time cut-off in the Marketing Handbook.

What I did see, however, is that AFTER the appeal has been rejected, a complaint can be filed with HPD or HDC.

If that government agency decides to issue a request to the marketing company to hold the apartment and leave it vacant for the person appealing/filing the complaint, then the marketing agency must do so.

What if, here, the apartment has already been given to another applicant and so my appeal is pending because it would be a problem if HPD/HDC decides that I should have the unit, but it is no longer available?

Does anyone have any idea how this works?

How are Split AMIs set up?

Where can I read about spilt AMIs in the marketing handbook?

I recently applied to a re rental, directly to the building itself, and they are using a split AMI model: their minimum income is in one AMI, and their maximum income is in another AMI.

The minimum income is in the higher part of one AMI, while their maximum income is in the mud part if another AMI.

Got rejected-but does not make sense

I got rejected, after months and months of ups, downs, twists and turns, of a re-rental, that I found accidentally prior to May of 2025, when the rules for re-rentals changed.

Everything was perfect: my income, my tax returns, my bank statements, my pay stubs...everything matched, and everything was within the EXACT income limit that the building had established.

The income limit, was so narrow, a 4k margin, neither in one full AMI nor another, but instead teethering at the higher limit of one, and at the lower limit of another.

After 6 months of the initial request for documents, I got contacted late March of 2026, because my log number had been reached.

Suddenly I had to re-submit all my documents, with an added 2 years of tax returns, and a 2 weeks window to tutn it in.

Everything was verified and accepted, and I got invited to a tour. The tour was for me solely, since my log number had been reached and the waiting list dated to prior May i

of 2025 with very few people on it.

After the tour, when I expressed interest, I was sent to the office of the third party company running the buildings affordable housing department.

Once there I was told to go and purchase a $25 money order for a credit check that I opted out of, but was told I still needed to submit the money order because I needed to go through a background check.

This background check was necessary prior to my package being sent to HDC.

When I asked what HDC was, I was told that my case was not under HPDs super vision, because the listing was never hosted on Housing Connect, but on their own independent website, and HDC is the ruling authority when Affordable Housing units go outside of Housing Connect.

I signed a bunch of paper, almost looking like an old school phone book, that is how many sheets if papers were in the packet, like the woman I met called it.

When I told her that I wanted to submit rent receits in lieu of a credit check the woman looked surprised. Then she said, that I needed a lease and receipts of payments. I explained to her that I have a room mate whom I pay to, not the actual landlord, and she said that I could submit a notorized statement from my room mate, stating how long I have lived with them and 12 months rent receipts as proof of payment alongside a cope of his lease.

I emailed all of it. A few hours later I was rejected.

I was rejected based on the fact that I needed to submit a LEASE, and a letter from my LANDLORD , and so because that was not what I had submitted, they decided to pull my credit, and I had over $5,000.00 of outstanding debt, which disqualifed me.

In the email, there is no mention of accounts being in delinquency.

There is also no mention of being rejected based upon thd rent receipts that I had submitted in lieu of the very credit check that I had asked to not go through.

There is no mention of where to appeal this decision.

I have now sent 2 emails to the person (yes 1 person deciding all of this, single handedly...) asking if perhaps there was a mistake, because I had submitted paperwork showing rent payments, and also having opted out of a credit check.

Do companies not need consent to pull a hard inquiry on your credit?

Does HPD not expressly make 2 options available for applicants: 12 months of rent receipts OR a credit check?

Why did this person want to conduct a background check on me PRIOR to submitting my package to a government agency, isn't that redundant because that is exactly whst the government agency is supposed to be doing?

Why do applicants have to pay money for a background check, isn't that only for credit checks?

Rent Receipts Instead of Credit Check

When you chose to not have a credit report pulled and instead opt for rent receipts payments. what exactly do they want to see?

I live with a room mate that I pay rent to. He is the lease holder, not me.

I have zelle transactions and cash withdrawals on my bank statements to show as proof of payment.

The problem is that these transactions are not on the same re occurring dates, rarely on the 1st of the month, and always different amounts because we also sometimes hang out and when he pays fir stuff I reimburse him with Zelle or cash.

in other words, my payments may not look like regular, once monthly or weekly, rent payments.

He will write a notorized letter stating how long I have lived as his room mate- longer than a year- and issue and sugn independent, paper receipts from a receipt book, showing every month paid in full.

Is this acceptable proof of rent payments?

I cannot do credit report, I had long covid and was off from work for years. The credit consequences were as bad as they get.
