A Radical Columbia Student Threatened The Lives Of Zionists. A Judge Just Tossed His Lawsuit.

James accused Columbia of discriminating against him. The judge wasn’t persuaded.

A former Columbia University student who went viral in 2024 after saying “Zionists don’t deserve to live” during a livestream of a disciplinary meeting has lost his lawsuit against the university.

Khymani James initially accused Columbia of discriminating against him because of his race and support for Palestinians, violating his rights under New York and New York City human rights laws, and failing to follow its own disciplinary procedures when it suspended him.

James’ suit then argued that Columbia violated his “Tedeschi rights,” which stem from a 1980 New York case requiring private universities to comply with their own disciplinary procedures. He also argued that the university punished him twice for conduct related to his January livestream and allowed outside pressure to influence its disciplinary decisions.

New York State Supreme Court Justice Kathleen Waterman-Marshall dismissed James’ complaint on July 3, 2026, ruling that he could not pursue his “Tedeschi rights” claim as a standalone lawsuit and that he had failed to adequately plead his discrimination claims.

During the 2024 livestream of a meeting with Columbia’s Center for Student Success and Intervention, which had summoned James to discuss earlier antisemitic comments, he said “there should not be Zionists anywhere” and “the world is better without them,” while comparing killing Zionists to killing Adolf Hitler.

James was initially placed on disciplinary probation after Columbia determined in April 2024 that he violated university policies by livestreaming a January disciplinary meeting without permission and using language that “denigrates or shows hostility or aversion toward group members of a protected class.” The probation period allowed him to continue his academic progress on the condition that further violations could lead to additional disciplinary action.

Columbia then suspended him one day after The Daily Wire reported his comments on April 25 of that year. At the time, James was participating in the university’s ongoing anti-Israel encampment, where he served as a media liaison and “member of the safety team.”

His request to re-enroll for the fall 2025 semester was denied because of what Columbia described as “insufficient” reflection on the conduct that led to his suspension.

In the lawsuit, James claims the university only suspended him to save face amid national backlash.

“The timing and language of the sanction letter makes it clear that Columbia acted in response to external forces and national media attention,” the suit stated. “The university is allowing external forces, applying pressure to it, to dictate outcomes in individual student disciplinary cases.”

When announcing the lawsuit, James accused Columbia of discrimination, as well as “cowering” to “billionaire donors” and “fascist politicians.” In a follow-up tweet, he posted a picture of himself flipping off the camera on a jet ski.

Since leaving Columbia, James has continued making incendiary statements, including posts that appeared to praise the killing of Turning Point USA founder Charlie Kirk in September.

On the day Kirk was assassinated, James tweeted a heart-eye emoji alongside “down with all the fascists” and “More. MORE!!!”

Rep. Virginia Foxx, the former chair of the House Committee on Education and the Workforce, responded to his posts accusing the school of failing to suspend him despite the university telling her he would be. 

“He was not expelled. Nothing was done. [Columbia] you have failed again, again, and again,” Foxx posted.

Columbia responded by confirming that James has been barred from campus since April 2024 and that he is not a registered student.

James responded by filing a lawsuit against Foxx accusing her of using her position of power to punish him for his “First Amendment-protected criticism of Israel and the Palestinian people” by obtaining his expulsion from Columbia.

When announcing the suit, James tweeted at Foxx, writing “don’t die yet, I’m suing you.”

Foxx accused the suit of lacking “credibility and factual basis.”

The suit remains ongoing.

In April 2026, James claimed he was temporarily prevented from re-entering the U.S. from Canada after he refused to allow Customs and Border Protection officers to search his electronic devices. He accused officials of targeting him for his pro-Palestinian activism, calling the situation “crazy, lame, and ILLEGAL AS F*CK” and adding, “I’m a CITIZEN, HOE!” James later said he had returned to the U.S. without surrendering his devices and thanked his “friends and comrades” for helping him get back safely.

The events that led to James’ lawsuit against Columbia began after he posted on social media that Zionists who wanted to “meet up and fight” should know that he “fights to kill.” According to James’ lawsuit, he made the comments after receiving hateful messages over his support for Palestinians and said he intended to deter people from harming him.

Columbia’s Center for Student Success and Intervention then summoned James to a January 9 meeting to discuss complaints about his posts. According to the lawsuit, James livestreamed the meeting because he felt endangered and wanted to show what he viewed as Columbia’s repression of pro-Palestinian students and people of color.

During the meeting, James said he was “very comfortable” calling for Zionists to die and compared killing Zionists to killing Nazis, fascists, and racists.

“Zionists don’t deserve to live comfortably, let alone Zionists don’t deserve to live,” James said. “The same way we are very comfortable accepting Nazis don’t deserve to live, fascists don’t deserve to live, racists don’t deserve to live, Zionists, they shouldn’t live in this world.”

“Be grateful that I’m not just going out and murdering Zionists,” James also said. “I’ve never hurt anyone in my life, and I hope to keep it that way.”

James was barred from Columbia’s campuses and prevented from completing the semester, according to the lawsuit. The suit also claimed that no other student was suspended that day for participating in the encampment, though other students were suspended on different days.

In a since-deleted April post on X, James claimed he “misspoke” when he repeatedly called for Zionists to die in the January livestream.

In May, James received another letter for participating in a “human chain” at the encampment. A viral video showed James directing protesters to push pro-Israel students out of the encampment. The lawsuit states James was “reasonably engaged in peaceful self help” in this incident.

“One step forward,” James was seen yelling as the crowd repeated after him in unison while stepping forward.

James received a letter in August notifying him that he was suspended for the academic year for his participation in the human chain, the suit states. James has received death threats and suffered from anxiety, fear, and depression since his suspension, the suit claims.

The lawsuit then launches into a tirade against the House of Representatives Committee on Education and the Workforce, comparing its hearings on college antisemitism to bringing “a new form orf [sic] McCarthyism to the American scene.

Inside the Green Party group chats that discussed ‘killing Zionists’

WhatsApp messages show talk of wiping Israel off the map, support for the Iranian regime and claims that anti-Jewish hostility is understandable

Sophus Magill, a Green Party parish councillor, created the private WhatsApp group where the messages were shared

Green Party activists claimed British Jews were a “weapon” of Israel and described hostility towards Jews as “understandable”, leaked messages show.

Participants in a private WhatsApp group used by Green members discussed “killing Zionists” and described the majority of Israeli Jews as “genociders”. Separate comments on the party’s conference forum defended “violent resistance” and “armed struggle” by Palestinians.

The group, Greens Against Imperialism, was created by Sophus Magill, a Green Party parish councillor in Wootton Bridge on the Isle of Wight.

During one discussion, Magill wrote that “Zionism has to go”, adding: “The only solution is one equal state.” When another participant asked whether that meant wanting Israel “wiped off the map, in essence?”, Magill replied: “Yes, I would like that.”

He later said he did not think it was violent to want “an illegitimate apartheid state gone from all maps”, comparing Israel to Rhodesia. Magill said that Israeli citizens who were not war criminals and agreed to coexist peacefully with Palestinians had a right to live there.

Another group member wrote: “I think a lot of British Jews have been heavily exposed to the propoganda [sic].” They added: “British Jews are a brilliant weapon for the Israeli state to help with the use of antisemitism as a justification in the UK…”

The group was used by members and activists to discuss party campaigning, conference motions and foreign policy. The messages threaten to reignite a row over antisemitism in the party.

One participant using the initials “AT” described Iran’s Islamic Revolutionary Guard Corps (IRGC) as “by definition part of a national liberation movement”. The account wrote on June 16: “They are part of the Islamic Revolution of Iran. They liberated themselves from a US puppet regime of the Shah in 1979. The IRGC were one of the organisations leading that.”

AT also claimed that protests against the Iranian regime this year “were instigated and armed by the Americans and the Zionists”.

The Times understands AT is Ashley Tubb, who stood for election to the Green Party’s campaigns committee last year. Evidence linking the account to Tubb included a Word document uploaded to the WhatsApp group on June 23 whose metadata named “Tubb, Ashley” as the last person to modify it. In a separate Whatsapp group the number appeared alongside the name “Ash Tubb”.

The Jewish Chronicle had previously identified AT as Tubb in a report about opposition to banning the IRGC and published a response from Tubb defending their opposition to the measure. When approached by The Times the account did not deny being Tubb or making the comments.

The June comments predated the IRGC’s formal designation as a threat to the state on July 17 under new powers. It is not suggested that the comments were illegal.

Another participant wrote: “I suppose an extreme anti-zionist could mean that you support killing Zionists. But that is not specifically racist…” In the same message, they said that “lumping all Jews in with the majority of Israeli Jews as Genociders” was “wrong” but that such anti-Jewish hostility was “understandable”.

David Taylor, the Labour MP for Hemel Hempstead, said the comments were “sickening” and “just go to show how extreme the Green Party has become”. He added: “The Greens must identify these members immediately, expel them from the party and report them to the police.”

Lord Walney, the government’s former extremism tsar, added: “This sinister justification of political violence from Green Party activists puts British Jews in increased danger of attack, and highlights the virulent antisemitism infecting much of the so-called progressive left in the UK. If the Green Party continues to deny the extremism they are stoking, they should be treated in the same way as far right parties who excuse or promote violence.”

The private group also included members with formal roles inside the party and its affiliated groups.

Animah Kosai, who is the membership officer of Global Majority Greens, an official Green Party special interest group that includes Mothin Ali, the party’s deputy leader, invited members of Greens Against Imperialism to join a Global Majority Greens review of conference motions.

She wrote: “I know I’ve asked this before — who wants to join the GMG & Allies review of the motions. Basically it’s for this group too, but given that GMG is a formal special interest group, we are happy to provide cover.” Kosai also promoted the “Zionism is Racism” motion in the group and later referred to it as “our motion”.

At least one member of the WhatsApp group eventually left because of its atmosphere. They wrote: “I’m now having to leave this group for my own sanity … I cannot handle the amount of energy and anger within this WhatsApp group.”

Magill, Tubb and Kosai were all approached for comment. A spokesperson for the Green Party said: “We do not comment on internal party forums or discussions on WhatsApp groups that are not official party group channels.”

When IDF special forces rescued hostages in Nuseirat on June 8, 2024 many Gazan fatalities were claimed as a result of the raid, all presented as civilian. But now Gazans admit that armed men in regular clothes confronted the IDF in combat. There’s even a video of it!

Malik Ahmed Al-Afandi was 15 years old and part of PIJ’s Al-Quds Brigade. He was in the Al-Radwan Battalion of the Gaza Brigade. 15-year-old Mahmoud Moussa Nassir was in the Northern Brigade’s Rocket Unit. 15-year-old Qusay Kamel Washah was in the Northern Brigade’s Central Mobilization unit. Washah’s “mujahid” and “martyr” statuses were announced by PIJ on August 9, while the former two were announced on August 11.

Child Soldier Problem Continues to Unfold

PIJ had begun to release the names of slain child soldiers in July, as previously reported by HonestReporting, and continued to publish martyr notices of older boys since.

On August 9, the terrorist organization claimed 16-year-old Jumaa Khalil Ghubn as a member of the Al-Quds Brigade’s Northern Brigade Central Mobilization Unit. On July 23, 16-year-old Abdul Hadi Abdullah Al-Najjar was announced as a deceased member of the Khan Yunis Brigade’s Al-Balad Battalion. Seventeen-year-old Ashraf Abdul Karim Khattab was announced dead on August 6.

In addition to another nine child soldiers detailed by HonestReporting at the end of July, another 11 have since been confirmed by matching their faces, names, and other identifying details in martyr notices, social media posts, and casualty databases. There are others who are suspected child soldiers, but there was not enough supporting evidence to confirm their identities.

DFLP Reveals Child Soldier Use

The PIJ is not the only terrorist organization to have admitted to the use of child soldiers since July. On July 30, the Democratic Front for the Liberation of Palestine (DFLP) published a martyr video for Ahmed Salem Sukkar showing him armed and uniformed. The title screen for the video detailed that Sukkar was born in 2006 and died in 2023, meaning that at most he would have been 17. Indeed, online Palestinian casualty databases listed a 17-year-old boy of the same age that died in October 2023.

The DFLP also listed 17-year-old Nabil Ismail Jarbu’ as one of the fighters in its Martyr Omar al-Qasim Forces. According to Facebook posts by deceased DFLP field commander Ismail Nabi Jarbu’ and his wife, the younger Jarbu’ appeared to be his son. On August 6, the 17-year-old was claimed by PIJ as a member of its Central Brigade’s Nuseirat Battalion. It is unclear if Jarbu’ had membership with both terrorist organizations, or was only commemorated by the DFLP due to his father’s rank in the terrorist organization.

The case is notable not only due to Jarbu’s possible dual allegiance, but also because it is representative of a wider trend with child terrorists. Israel Policy Forum senior Policy Associate Gabriel Epstein, who has also been tracking the growing evidence of the practice of Gazan groups recruiting children, noted on Monday on X a pattern in which the child soldiers were part of families with members in terrorist organizations. He noted that in some cases the child combatants were killed in the same strike as their terrorist family members, while others had familial ties to those dying elsewhere in the October 7 War or another war.

Muhammad Zuhair Al-Amsi was announced on August 5 by PIJ’s Al-Quds Brigades to be a member of its Rafah Brigade’s Al-Shaboura Battalion. According to Epstein, Al-Amsi was 16 years old at the time of his death. He was also reportedly the son of Rafah Brigade Central Intelligence Unit platoon commander Zuheir Rajab Mohammed al-Amsi.

Seventeen-year-old Abdullah Imad Al-Ajez was in the Rafah Brigade’s Military Manufacturing Unit, according to August 5 statements by PIJ. Epstein linked Al-Ajez to his father, Imad Hassan Mohammed al-Ajiz, commander of PIJ’s military manufacturing. Al-Ajez had a brother and cousin in the same unit as him, both of whom also had martyr notices issued for them.

On July 17, PIJ claimed 16-year-old Fawzi Kamel Fawzi Washah as a member of the Northern Brigade’s Martyr Hussam Abu Habl Battalion. According to Epstein, he was the son of high-ranking PIJ Central Information Unit commander Kamel Fawzi Washah. The analyst also suspected militancy from Washa’s other children.

Still No News Coverage of Child Soldiers

It has been almost a month since PIJ began to announce its use of child soldiers through martyr posters, yet news outlets have not expressed any curiosity about the matter. Gaza is a lightning rod for news coverage, with outlets covering a wide variety of related stories. Yet while several major outlets including Reuters, The Washington Post, and CNN have all published human interest stories about struggling Gazan beekeepers, the deadly phenomenon of child soldiers has not garnered comparable coverage. The death of children in Gaza has been of significant interest to journalists, with 56 articles written by 32 outlets just about the June 18 Independent International Commission of Inquiry on the Occupied Palestinian Territory (COI) report alleging that the Israeli military deliberately targeted Palestinian children.

On August 6, UNICEF issued a statement declaring that 300 Gazan children had been killed in just as many days since the October 2025 ceasefire. UNICEF didn’t blame Israeli operations for the deaths directly, but addressed an unsafe environment in which violence was unfolding.

“Families are now crowded into roughly a third of the Gaza Strip, sheltering in unsafe conditions among destroyed buildings, rubble and accumulated solid waste. Across the Strip, children continue to face acute malnutrition, disease, unsafe water and damaged sanitation systems,” said UNICEF. “UNICEF calls on all parties to comply with their obligations under international law, including international humanitarian and human rights law. They must protect children, safeguard their access to essential goods and services, including healthcare, education, safe water and food, and allow and facilitate safe, rapid and unimpeded humanitarian access to children in need.”

Yet amid the series of factors that potentially were contributing to the death of children, the problem of children being sent into combat was not raised. Ten news articles were written about the short statement, but nothing has been done to address the emerging pattern about child soldiers.

An indication that the practice is known among Gazan media workers is a 2018 Facebook post by Drop Site News guest writer Ismail Nawfal. Middle East analyst Eitan Fischberger discovered that Nawfal had posted a fawning video of a Gaza kindergarten graduation ceremony in which the children acted out combat with mock firearms.

“A people who embrace their weapon from a young age will never be defeated,” Nawfal wrote.

The comfort level of Gazan news writers and the terrorist organizations to embrace the militarization suggests that the practice is not obscure.

Amid the lack of interest by the media, not only have younger child soldiers been confirmed, but a second terrorist organization has acknowledged its participation in the recruitment of children. The developments could reflect a sense of impunity about the practice — a sense that may be bolstered by a silent media.

The toxic libel by Palestinian Muslim extremists that “Al-Aqsa Mosque is in danger,” and Jews are to blame, has been used to incite antisemitic violence for over a century.

So, it’s not surprising that Hamas leaders named their Oct. 7 invasion and massacre in southern Israel “Al-Aqsa Flood,” creating the false rationale that the mass murder, rape, torture and mutilation on that day was an act of defense against a putative Israeli scheme to destroy or take-over the mosque.

One of the earliest uses of this libel – which is used to this day by Palestinian leaders to fuel violence – took place in the city of Hebron, Judaism’s second holiest city, in 1929.

Background

As CAMERA previously documented, in September 1928, a small group of Jews erected a mechitza (a divider to separate men and women during prayers) for Yom Kippur prayers at the Western Wall. The British dismantled the divider, but Haj Amin al Husseini, the Grand Mufti of Jerusalem and future Nazi collaborator, used the incident as a pretext to incite Muslims, accusing Jews of attempting to seize their holy sites, including the al Aqsa Mosque.

A propaganda campaign calling for jihad against the Jews resulted in the frequent attacks on Jews worshipping at the Wall and culminated in widespread, deadly riots across Palestine in August 1929.

Hebron Massacre

August 15, 1929 was Tisha B’Av, the day on which Jews commemorate the destruction of the Holy Temple, as well as other Jewish tragedies which took place on that date in the Hebrew calendar. Thousands of Jews marched to the Wall, peacefully protesting British restrictions on Jewish prayer there, and to reaffirm their Jewish connection to the holy site.

On August 17, a Jewish boy was killed by Arabs, in the Jerusalem neighborhood of Bukharan, who were inflamed by antisemitic sermons.

According to contemporaneous reports, including in the Davar newspaper of August 20, 1929, anti-Jewish incitement was rampant, especially in Jerusalem and Hebron. Rumors were spread that Jews had cursed Islam and intended to take over their holy places, while Muslims were told that it was their duty to take revenge. “Defend the Holy Places,” became the battle cry.

On August 23, more than 1,000 Arabs launched attacks on Jews throughout Jerusalem. Forty-seven people were killed. This was followed by widespread attacks on Jews throughout Palestine. The British forbade Jews to organise armed self-defense units and within several days, 133 Jews had been killed and 339 wounded.

According to Dutch-Canadian journalist Pierre Van Passen who was in Palestine at the time, fabricated pictures of Muslim holy sites in ruins were handed out to Hebron Arabs as they were leaving their mosques on Friday, August 23. The captions on the pictures claimed that the Dome of the Rock was bombed by the Zionists.

That evening, armed Arabs broke into the Yeshiva and murdered the lone student they found. The following day, an Arab mob wielding knives, axes, and iron bars destroyed the Yeshiva and murdered the rest of the students there. A delegation of Jewish residents on their way to the police station was lynched by an Arab mob. The mob then proceeded to Hebron, where Jews who had lived peacefully with their Arab neighbors for years.

The violence escalated, and mobs went door to door screaming, “Kill the Jews,” breaking into Jewish houses and torturing, castrating, raping and murdering the inhabitants – a deadly orgy of libel-fueled Palestinian violence foreshadowing the antisemitic barbarism we’d see – albeit on a much larger scale – on Oct. 7 2023.

Much like the Hebron rioters of 1929 praised Allah as they slaughtered men, women, and children, wrote Yardena Schwartz, author of “Ghosts of a Holy War”, so too did Hamas fighters, in footage they uploaded to social media.

In total, sixty-seven Jews in Hebron were killed and 60 were wounded over a two-hour period, while dozens more Jews were murdered in Jerusalem and in other cities. The Jewish community in Hebron – where Jews had lived since biblical times – was destroyed.

The Guardian

An Aug. 4 report at the outlet by Julian Borger (“Jerusalem’s most important Muslim religious site facing ‘imminent’ threat of Israeli takeover, says Jordan”) doesn’t merely legitimise the latest propaganda by Amman about the mosque being in danger.  It also uses the incendiary language of extremists in the journalist’s own voice:

Though the article later acknowledges that the Temple Mount is Judaism’s holiest site, which an editor’s note suggests came as the result of a complaint, it’s remarkable – even by Guardian standards – that they used the term “stormed” and “incursion” to describe what were peaceful Jewish visits to the Temple Mount/Al-Aqsa Mosque compound.

Such terms are typically used by PA-controlled and terrorist-friendly ‘news‘ sites to convey the dangerous lie that Jews are interlopers at the Temple Mount and that the mosque is in danger.

The article then reaches what we can confidently describe as a new low for the outlet in its coverage of Jerusalem:

It seems almost certain that the journalist is referring to the 1929 Hebron riots, as, though there were other periods of violence during the period between the wars, that was the only major incident that involved the alleged “infringement” by Jews on the Temple Mount.

While nothing much shocks us anymore about the Guardian’s institutional hostility to Israel and Jews, it’s important to stress that, until now, we’ve never previously encountered an inversion of the 1929 Palestinian pogrom that frames Jewish victims as the culprits at any other British outlet.  They effectively endorsed an antisemitic conspiracy theory that resulted in the barbaric slaughter of Jewish civilians in Hebron – a libel that continues to fuel jihadist violence against Jews to this day.

There is literally no moral line within their pathological antizionist campaign that the Guardian won’t cross.
