Sued by capital one

Today I was just served papers (being sued) by capital one for a discover credit card I had in college. I was making on time payments for 3 years but when I found out I was having a baby, me and my husband rushed into getting a house for our now family and I fell behind on payments. The reason I fell behind on payments is because the interest. I would make a payment and the interest would keep on coming so it was like I was constantly stuck. I need advice on what to do next and if anyone has been through this or is going through this.

Hello Everyone,
I just got a check of approximately $6,000.
I know Wells Fargo allows people to cash out there check and then deposit there check within the same day, so they can receive there funds without waiting until the next business day.
I just wanted to see if anyone knows if Bank of America can do the same thing so I can receive my full pay check today.
