H1b extension

I have very less days left for the H1b extension, since I was waiting on my i140 to get the extension. Is there a way a company can file for extension within a week?
Can they use previous LCA (1.5 years back used for transfer) if nothing in the role or duties have been changed?

Hi everyone,

I’m trying to understand realistic contingency options for my situation and would really appreciate hearing from anyone who has gone through something similar.

My situation:

  • H1B expires: May 15, 2026
  • EB2-NIW I-140 filed in premium processing
  • RFE received in March
  • RFE response submitted on March 29, 2026
  • Still waiting for final decision

I recently spoke with my employer’s immigration/HR team. They mentioned:

  • They would need at least ~2 weeks to obtain a certified LCA before filing any H1B extension
  • If timing becomes too tight, they may be able to support a B-2 Change of Status as a temporary bridge
  • But after May 15, I would need to stop working and go on unpaid leave until either:
    • the H1B is approved, or
    • I relocate to Canada

They also mentioned relocation to Canada could be an option if things don’t align in time.

My main questions are:

  1. If my NIW I-140 gets approved after I leave the U.S. and relocate to Canada, can my employer still file an H1B extension through consular processing and bring me back later?
  2. Has anyone here used Canada relocation as a temporary bridge while waiting for I-140 approval/H1B continuation?
  3. If the I-140 approval comes very close to the H1B expiration date, is there usually enough time to file the H1B extension with premium processing?
  4. Has anyone successfully used B-2 COS in a similar timing situation while waiting for immigration outcomes?

I know every case is different and I’ll ultimately follow attorney guidance, but I’d really appreciate hearing practical experiences from others who dealt with tight timelines like this.
