Trade for Shiny smeargle & Shiny spinda

Hi guys, I was playing ML today with xerneas, reshi and Ho. I encountered quite a few Ho-ohs and during 3 instances I brought in my ho-oh loaded with a brave bird against another ho-oh. When I threw the move, on all 3 occasions I lost CMP. Now I know for sure all 3 were maxed hundos and mine is also one. Why did I lose the CMP? I thought it was a 50-50 chance. Am I missing something? Please let me know.
