Clearly upset about the commentary produced by commentators who examined (and quoted directly from) the public record in the Lively/Baldoni action, Nathan turned to her ally, Boshoff for a hit piece. The narrative that Nathan planted and wants amplified? That commentary by pro-Lively commentators on the Lively/Baldoni action leads to harassment of her. Of her. The same Melissa Nathan who boasted that she can “bury anyone” and who has orchestrated harassment and smear campaigns against Amber Heard, Blake Lively, Stephanie Jones, Amanda Ghost, Alexa Nikolas, the victims of the Alexander Brothers (two of whom, the DA confirmed, were so intimidated that they did not give evidence at trial and another of whom was found dead shortly before trial).

That Melissa Nathan wants you to know that calling out her behavior leads to spikes in online harassment of her. Well, she wants you to know. But she doesn’t want you to know that she wants you to know. The original version of the Boshoff authored hit piece included a direct quote from Nathan claiming harassment. Hours later, an updated version was published which removed the reference to Nathan and re-attributed the “harassment” quote to “those involved in the case”. Thankfully, the Wayback machine preserved this about turn.

More than a settlement: 47.1 Motion and The NY "Speak Your Truth" Bill

Most of the headlines about the Wayfarer v. Lively settlement missed the most important part: the legal "teeth" Blake kept in the agreement.

As part of the settlement agreement, Blake explicitly reserved the right to pursue her motion for attorney's fees, treble damages and punitive damages (under section 47.1 of the California Code) against the Wayfarer Parties in relation to the Wayfarer v Lively action.

This isn't just about the money - it’s about judicial precedent.

This motion is historic. It marks the first time a judge will interpret 47.1 and decide how it should be applied. Once Judge Liman rules, this becomes the singular judicial authority on the application of 47.1 until another case comes along. The decision will be cited in future cases and taught in law schools.

By fighting to set a strong precedent now, Blake is helping to create a manual for how future survivors can defend themselves against retaliatory defamation lawsuits.

If she wins, she would have helped solidify a legal barrier that prevents abusers from using the court system to silence survivors. This will be her legacy.

It won’t be an easy win. Feminist and defender of survivors Baldoni and his team have argued in court filings that 47.1 is unconstitutional. This only serves to undermine the legitimacy of the law and weaken protections for survivors of abuse.  Arguments made by Baldoni will be cited by future abusers as they seek to evade the reach of 47.1. This will be his legacy.

New York Speak Your Truth Bill

Blake isn't just fighting through the 47.1 motion. Her attorney, Sigrid McCawley, stated this week that Blake is engaging in advocacy work behind the scenes to help get the New York Speak Your Truth Bill (and similar measures in other States) passed into law. The Bill is sponsored by Senator Brad Hoylman-Sigal and Assembly member Jessica González-Rojas and is designed to protect survivors of sexual assault, harassment, and discrimination from retaliatory defamation lawsuits filed by abusers by making accounts of abuse "privileged communications" (essentially, NY's version of 47.1). The Bill is at committee stage, making its way through the NY State Senate and the NY State Assembly. The deposition transcript of former TAG employee, Katie Case, was fully unsealed yesterday. She confirmed that Melissa Nathan asked her to work with the Alexander Brothers on a website that would be used in their litigation.

The website smeared the victims of the brothers, labelling them lairs, extortioners etc. one of the victims smeared, Kate Whiteman, was found dead shortly before the trial. Friends suggested that she took her life.

Charlotte MacInnes’ legal team has alleged in court that Rebel Wilson commissioned a private investigator report on Amanda Ghost, her husband Gregor Cameron and through that obtained personal details including photos of their children, address details and their social media passwords.

MacInnes testified that her Snapchat account was hacked, private photos accessed and distributed to all of her contacts. Attempts were made to hack her Facebook account and that of her mother. MacInnes believes the hack was orchestrated by Rebel Wilson.

The court has ordered that Rebel Wilson’s team provide all private investigator reports produced, including those in relation to MacInnes and members of her family.

The private Investigator, Sourced Intelligence, is a frequent collaborator with the team that Rebel was working with at the time (Bryan Freedman, Melissa Nathan of TAG PR and Jed Wallace).

On a side note - Sourced Intelligence produced a report on Blake Lively at the request of Justin Baldoni and Wayfarer. It’s unclear what information they obtained and what they used it for, but will be interesting to see how all this plays out at trial.

There’s something highly scummy (if not abusive and illegal) about obtaining the social media passwords of your adversary and photos of their children.
