I live in Georgia with my wife and our 11 year old child. My wife has been a SAHM for years and I earn about $70k. We own a home valued at around $300k with a mortgage of $185k @ 2.5% interest rate ( we bought in 2021). A car valued about 29k with an auto loan of 28k). No student loans but we have over $60k credit card debt due to HVAC/home repair, can't afford car payment, inflation, and I personally helped my sister and my mother-in-law for about $47k over the past few years. $30k went to my sister and over the past 2 years, I cash advanced $20k over my credit cards to cash app her.
I know. It was dumb, it was always last minute past due rent/car payment so she and her kids were facing eviction and/or car repo. I am at a point where I can no longer pay all the monthly minimum payments and buy grocery. So I am considering ch 7 bankruptcy. I am below the mean income test, my home equity should be protected given both I and my wife file jointly... But my concern is the transferring of cash to my family member.
To be clear, I cash advanced back in Feb for 5k to send to her, then in the month of July/August, she was behind essentially on all of her bills for multiple months, I cash advanced about $12000 and cash app to her because her landlord requires certified checks. I can hold off on bankruptcy until next year if I have to, but my worry is, will all these transfers be a problem with my ch 7 petition? I will talk to a lawyer but I just want to get some preliminary information here.
Thank you!
