Assalamualaikum.

I wanted to know if a head of institute has 2.5 years of service remaining and the FDE is trying to transfer them.Can the person take stay on orders by high court?(The service tribunal takes a lot of time)

The reason for taking stay via high court/not wanting the transfer is as follows:

.The individual has an intellectually disabled child that depends on them for daily life activities like changing clothes, handling the monthly cycle,etc.

.The child travels with this individual and is emotionally also connected to the routine as her results suffered because of an earlier transfer that the employee complied to as the person had many years of service left and served in the transferred area for 6-7 years.

.Upon seeing the impact on the physical care and the emotional well-being,the employee drafted an application when a seat was available in the city which was accepted by Director Schools FDE and the person was transferred from rural area to a place near their child's institution of study.

.The child has a disability certificate issued by the concerned authority of Pakistan and this is also reflected on the CNIC of the said child.

(The child is 21 years old but suffers from age regression and has the mental capability of a 5 year old if anyone is concerned about the age and all)

.Also the employee has worked very well in both urban and rural sector and their are no performance related issues to make this transfer.

What steps can legally be taken if the department knowingly makes the decision to transfer the employee?
