The legal definition of material times?

  1. Does it mean the employer could have known or did know at the time of the complaint? Ie discrimination harassment.

  2. Could someone please explain the exact legal definition of material times?

Thanks all

Company internal policy injury allowance section 22 must be asked on independent medical appointment!

  1. Can it be added as further active victimisation?

  2. The company produced the internal policy but did not follow it. Employee at financial disadvantage.

CAN I ADD FURTHER VICTIMISATION AFTER PROTECTED ACT? LINE MANAGER AND I/O written in final report I was crazy and highly aggressive and shouting in a different meeting before the incident happened. Now after months and no reported incident the line manager claims I was super aggressive and crazy

  1. Is this after the incident then after the grievance and then after the end of early conciliation? Is this classed at victimisation?

  2. I can 100% prove how professional I was in this meeting. The line manager even emailed me hour later thanking me for the meeting and saying what a positive great meeting it was.

Now after I have placed a formal grievance and legal claims I was crazy 😂

I read that active employees have a higher chance of being offered a clean break offer from R). Has anyone got any accurate experience with this and without?

  1. Anyone while employed get a clean break offer?

  2. Anyone get a resolution return offer?

  3. I’m at ET3 stage, but it’s very hard as I’m also dealing with internal protocol and procedures.

Afew weeks after their ET3 due date. I received a reply regarding the Grievance Outcome being emailed to me this week! My question is this! After waiting nearly 160 days for this report and it’s only the first stage NOT appeal! How likely is an upheld or partial outcome?

  1. Or is it just to show the ET that we have completed the internal complaint.

2
. Or is it an opportunity to show me they have listened and could award a remedy ie written apology or a small compensation payment.

3 Anyone had this just before or after the ET3 date?

SECOND OCCUPATIONAL HEALTH REFERRAL MEDICALLY INACCURATE! Politely and professionally objected to the line manager and head of HR. Reason this falls in this category is the occupational health team can also assess whether my current absence and diagnosis is caused by the employer. UK

  1. Should I email the occupational health team directly get it on record that the employer has now twice issued an inaccurate referral!

  2. Would it hurt me alerting the administration team to possibly have something placed on my file as I’ve used them before that my GP medical diagnosis is being altered and having the word depression removed! Along with stating I’m in probationary employee when this is inaccurate.

  3. I would like the O/H nurse to have the facts and a true understanding of the situation prior to the appointment.

What does everyone think?

I welcome advice? Thanks all

DOES IT WEAKEN A RESPONDENTS DEFENCE IF THEY HAVE TO ISSUE AN ET3 WITHOUT ANY STAGE OF A FORMAL GRIEVANCE REPORT? Ie nothing issued to the employee! Let’s say 5 months since the complaint.

Written grievance formal no report or any stage report.

I am thinking how does a (R) write a defence when they have no employer internal report?

Of course I am thinking they write something like still ongoing as giving it massive investigation. Or something with a spin.

Cheers all

Urgent advice! DISABILITY DISCRIMINATION AND HARASSMENT.. Currently off sick caused by the workplace! The employer has issued inaccurate medical data occupational health referral

If I consent to this incorrect referral where the employer has again medically incorrectly entered the text? Will this damage my ET claim? Or strengthen as I can prove it’s medically and factually inaccurate?

I’m still actively employed but employer is having zero contact now! I am signed off sick from GP, but they are blanking my emails since getting the ET1. I’m signed off sick with depression caused by the incident. How can an employee get back to work and recover if no duty of care?

ET3s DO they always challenge Disabilities??Even if the employer has actual written knowledge? Internal occupational health confirming also. Is it standard to challenge?

Grievance first stage outcome still not issued at four months stage. Terms of reference agreed via email. ACAS all actioned. My question is why do employers unreasonably delay the process which can make it worse for them?
