Went to IME, he told me my surgery failed.

I had ECRB surgery for a completely torn common extensor tendon in my elbow after a fall on ice at work. Surgery was 9 months ago. Doctor had me off work for 6 months and I’ve been on light duty since coming back.

A few days ago I had 2 appts. First was with my ortho to discuss my most recent MRI results. He sends me back to therapy. 2 hours later I see a different doctor for an IME and he looked at me and said I’m sorry but the surgery failed. I was honestly confused. He said that because I’m in the same if not more pain than before surgery then it failed to treat my symptoms even though the tendon has been repaired successfully. He said he would’ve moved to have treated me but he couldn’t because he was hired by the insurance company. He didn’t understand why my doctor had me off work for 6 months and I did 5 months of therapy with no major results. He then proceeded to refer me to a specialist who only works on elbows and shoulders.

Any ideas on what my next steps will be? Does workers comp have to keep paying since their doctor said I’m not healed?

Do I need to go to the desk?

I will be flying Allegiant for the first time today. I checked in online and have my boarding pass (that states I paid for my carry on). Do I need to go to the desk/ticket counter or can I bypass and go straight through TSA and to the gate?

I usually fly Southwest but with all the changes I chose to change and I also check at least 1 bag so this is new to me.

I got hurt at work, I’ve been to therapy, I had surgery and was out of work for 6 months and more therapy. Workers comp paid for everything. What is the point in suing workers comp? I feel like this is a dumb question but I genuinely don’t understand. I am suing the landlord for where my office used to be because they were supposed to keep the sidewalks clear and they did not resulting in me falling on ice.

I do have a workers comp attorney but as of right now he’s just making sure I’m getting the treatment I deserve.
