Signed a new employment contract with my current employer. Mistake made on the contract, how binding is it?
I work for one of the big 5 banks in Ontario. I was in a part time position that paid hourly for a couple of years. I was recently given the opportunity to do the same job with full time hours (salary position).
The first employment contract they gave me to sign was incorrect, it had my name in the header and another employees name in the body of the letter.
I gave it back to my manager who sent it back to hr and had a new one drawn up. I signed the correct second letter as did my manager and it was submitted and was paid retroactively from May 1 2026.
I have now been told that the salary in the contract was incorrect and I would need to pay back the difference.
When i signed the contract I honestly didn’t realize the salary was incorrect as I was paid hourly and didn’t do the math to see if the number on the contract was correct (it is a difference of about $6000.00 annually in my favour)
What are my rights? Is the contract binding and do I have to pay back the difference from May 1 2026 to date?
