One of our clients came to us after China Customs held his shipment for “trademark infringement” — on his own brand.
He had been working with the same factory in Guangdong for almost 2 years. Same logo, same packaging, same products.
What he did not know:
The supplier had quietly registered the trademark in China before he did.
And China works on a first-to-file system, not first-to-use.
So even though the client owned the brand in the US and sold successfully on Amazon, the factory legally controlled the trademark inside China.
Result:
The biggest mistake?
Thinking a USPTO trademark protects you in China.
It does not.
