Let's hear those stupid messed up claims!

Mine: Customer had a bathroom emergency and soiled themselves...filed a claim stating they got food poisoning at the location. Insured location/business does not prepare or sell food...only has complimentary sealed bottles of water.

The fact I even had a claim assignment for this is just plain stupid.

Mine - claimant states they tripped and fell on the property. Can't give me a date of incident so I can get the security footage. Can't tell me what/why they tripped. Can't even tell me which of the 100+ locations we insure in the area that they are indicating. Not sure how our intake even set this up.

Mine - not really wacky, but all too common. Denied a claim over a year ago - with clear video evidence. Just got in a new letter of rep - 4th different attorney in 14 months.

#2 - LOR for a hit and run against my client...from 3 years go. SOL runs in a few months. No police report, no dash camera, no witnesses, no photos. Asked the attorney how we are identified, and they said the claimant indicated it was us. No plate number, driver info, location, time of day or anything that would help us investigate... denial coming soon. Some attorneys will take any case.

Claimant calls in screaming about injury and property damage - claim happened 30 minutes ago and I got it assigned 5 minutes ago.

Already demanding rental... 😂

Scooter claims

I am seeing a massive amount of new claims for people crashing e-bikes and scooters. They have accidents in parking lots/sidewalks near our insured locations. I figured the increase is due to summer vacation etc.

Struggling with liability on these as it appears it's operator error on 99.99% of these.

Just this morning I was walking the dog, and watched an adult (or older mature teenager) on a stand up scooter blow through a stop sign. They were not wearing a helmet or shoes.

At what point does the inability to maintain control on these injury machines become my insureds responsibility for simply having a retail location nearby?

Unrepped claimant tells me that money is not good enough for a settlement and wants felony charges pressed on my insured (😂). Loss facts - claimant walked into a glass door and fell down. The door has signs and a push bar on the inside, huge handle on the outside...you know, a fucking door you would find on 99.99% of any business. My current offer is $250.00 for them to just go away.

M&M will truly take any client. They rep a homeowner who tripped and fell in their own property (condo complex) - after 3 weeks of trying to get any info as to how my insured (a commercial GL policy) is liable, I still have no response from M&M (15 calls and emails). My insured only provides a service to the residence (utilities), and has no actual equipment near or in the condo unit.

Ridiculous attorney requests

New LOR has 70 different preservation requirements (floppy discs? 😂 What year are we in?)...from a claim from 2023. All that stuff is long gone.

I also got multiple emails from an attorney on July 4-6th that sent a demand on July 3rd at 9:45pm. Take a fucking break for the holiday dude.

And I got cussed out because our insured did not have optional UM coverage.

Just having a Tuesday vent session.

I have a claim in a pure contributory state...claimant hit a stationary object - and is getting an attorney. No medical treatment whatsoever. The object - a tree branch that fell after a storm and was in the road.

Mine - attorney filed a claim for what his client is saying is a hit and run...my insured Is supposed to be changing lanes. It's a walk in police report...police did not respond to the scene.

I show the photos my insured driver took of the claimant DL and insurance info - so clearly not a hit and run. Attorney then states we still hit his client...oh yeah? Wanna see the dash camera footage I said..dead silence. Claimant was entering the road from a side street and hit my insured in the passenger side. 1% contributory state too...I wish they all were this easy

I got one where the claimant has called and emailed me 10x since yesterday when I got the claim and keeps saying that he is a victim of a crime...uh, you tripped on a public sidewalk in a strip mall, not in my insured location.

More of a rant than anything this week...

  1. Don't send me "thank you" emails...I get/send hundreds of emails a week. I don't need these.

  2. Our loss reporting/intake dept freaking sucks. Proficiency in English should be job requirement number one skill required. Can't even get names correct - Cindy vs Sidney...address in Maryland with a Texas zip code...

  3. Insureds completely misrepresenting loss facts. Tell me it's a single car loss vs a stationary object, no damage to insured vehicle. Yeah, not what happened at all...

  4. People leaving a voicemail at 9pm and sending an email seconds later to see if I got the voicemail. It's 9pm fuckers, I don't work 16 hour days!!!

I really wish I could give specifics on some of these ridiculous claims filed against my insured... especially the GL injury claims.

I don't understand how people hurt themselves by not paying attention to where they are walking, trip and then immediately get an attorney. You walked into a stationary object (and I count a wall as a stationary object!) that is clearly marked and obvious. People have no shame or self accountability for their own negligence.

So far this month I have 8 new claims reported/assigned that are mere weeks from the SOL running... asking me to preserve evidence and such from 2-3 years ago. Just shaking my head at this stuff. Rep letters are so generic that you can't even tell if it's a general liability or auto claim.

I know it's not, but there should be a bad faith option for reporting claims this far past the date of loss
