Article 8 family life and exceptional circumstances visa route

Hi,

I need some help please, from anyone with the knowledge/experience I would really appreciate.

I am a British citizen and I have a partner who lives abroad but we have a young child together who is also a British citizen and lives with my in the UK.

For sometime now we have been trying to bring my partner over to the uk so we can be a family but it seems impossible.

I am a qualified nurse but I am unemployed because there’s literally no jobs out the at the moment. I have applied to numerous jobs but no success, I have even applied to care/support worker roles and no success. I have not given up and I am still actively looking for a job so that we can apply for spouse visa and bring my partner to live with us in the UK.

But I am really starting to lose hope with the job hunting and without it it’s impossible to apply for spouse visa and that will force myself and my British child to move away from our extended family from the UK and relocate to where to partner lives so that we can be a family and that will not my in the best interest of our child or our family in general.

I receive child benefit and also universal credit.

Is there any hope that we could apply through Article 8 family life and exceptional circumstances visa route or any other routes for that matter?

PLEASE WE REALLY NEED SOME ADVICE AND GUIDANCE.

Partner visa financial requirement – can regular overtime be used to meet the threshold?

Hi everyone,

I’m looking for some advice from anyone who has experience with the UK partner/spouse visa financial requirement, especially where overtime is involved.

I’m currently working in a support worker role in the UK on a 42-hour weekly contract. My basic salary is slightly below the £29,000 annual threshold needed for the visa, but my role does offer overtime opportunities.

The overtime is not guaranteed, but it is available fairly regularly depending on staffing levels (for example sickness cover, extra shifts, etc.).

My employer has said I can pick up overtime, but it depends on availability rather than being fixed or guaranteed each month.

I’m trying to understand how UKVI treats overtime in this situation. From what I’ve read, it seems that:

overtime can be included in the financial calculation if it is evidenced on payslips

income is often averaged over the last 6 months and annualised

but it must be consistent enough to be considered reliable

My questions are:

Has anyone successfully used regular but non-guaranteed overtime to meet the financial requirement?

Does UKVI accept overtime that is available but not contracted/guaranteed, as long as it appears consistently on payslips?

In practice, did your application get approved where overtime made up part of the income?

Would it be safer to wait until 6 months of consistent overtime history before applying?

I’m trying to work out whether building overtime over the next few months would realistically make my application strong enough, or whether I should rely only on base salary for safety.

Any experiences or advice would be really appreciated.

HELP!!

Please I need help, currently in the process of submitting a fee waiver for my partner’s visa application as we are both not in a position to pay for the fees.

However, we are submitting the fee waiver on Monday and I got a job offer today but won’t be starting just yet.

Will this or could this affect our fee waiver being accepted?

Please I need advice.
