Need advice regarding BPI home loan surrender/foreclosure

Hello sa lahat,

Gusto ko sana humingi ng advice sa mga nakaranas na ng ganitong sitwasyon.

Noong nakaraang taon, kumuha ako ng BPI home loan na nasa ₱10M. Nagbayad ako ng around 30% down payment, at nakatira na ako sa unit nang halos isang taon.

Sa kasamaang palad, ngayong taon, bumagsak ang negosyo ko, at hindi ko na kayang bayaran ang monthly amortization. Sinubukan ko na rin itong ipasale o ipa-assume, pero hanggang ngayon wala pa ring buyer.

Nakipag-ugnayan na rin ako sa bangko tungkol sa sitwasyon ko at humingi ng possible options, pero sa ngayon wala pa akong nakuhang maayos na sagot o arrangement.

Sa puntong ito, iniisip ko na talagang bitawan na ang property. Handa akong tanggapin ang financial loss dahil sobrang bigat na rin ng monthly payments sa akin. Mas gusto ko na lang harapin ang financial consequences ngayon, magsimulang mag-ipon ulit, at buuin muli ang finances ko mula sa simula.

Mga tanong ko:

  1. Dapat ko bang pormal na lapitan ang BPI at hilingin na isuko/iturn over ang property, o mas mabuti bang tumigil na lang sa pagbabayad at hintayin ang foreclosure process?

  2. Kung mag-default ako at ma-foreclose ang property, maaari pa bang habulin ng BPI ang anumang deficiency kung hindi sapat ang proceeds ng foreclosure sale para mabayaran ang natitirang loan balance?

  3. Binili ko ang unit na bare, kaya lahat ng appliances at movable furniture sa loob ay personal kong binili. Kung sakaling i-turn over ko ang property sa bangko, maaari ko bang dalhin ang mga appliances at personal na gamit na ito? Ang tinutukoy ko ay mga movable items na ako mismo ang bumili at hindi built-in fixtures o bahagi ng property.

  4. May dapat ba akong gawin bago tumigil sa pagbabayad para mabawasan ang penalties, legal issues, o financial damage?

  5. Para sa mga nakaranas na ng ganitong sitwasyon sa BPI o ibang bangko, ano ang maipapayo ninyo ipagpatuloy ang pagbebenta o pag-assume ng property, makipag-negotiate sa bangko, o hayaan na lang na umabot sa foreclosure?

Alam ko na posibleng maapektuhan ang credit standing ko, at sa ngayon handa na akong tanggapin iyon. Ang priority ko ay mapigilan na lumala pa ang financial situation ko at makapag rebuild ng finances at peace of mind.

Alam ko rin na may mga posibleng consequences ang default, kabilang ang deficiency balance, kaya sobrang appreciate ko ang anumang advice mula sa mga nakaranas na nito.

Home Loan BPI

Hi everyone,

It took a lot of courage for me to post this, but I really need advice and perspective from people who may have experienced something similar.

I’m 35M and a breadwinner of my family. For the past few years, I’ve been financially supporting my family, especially when my brother became seriously ill. We spent around two years going in and out of the hospital, and since I was the one who could financially provide, I kept doing the “tapal system” just to keep everything going.

I also want to acknowledge that aside from the circumstances I was dealing with, I made some bad financial decisions along the way. I borrowed and used credit cards to cover expenses and existing obligations, thinking I would eventually be able to catch up. Unfortunately, the debt kept accumulating, and what started as trying to survive financially eventually became a cycle that I could no longer sustain.

In 2025, I decided to get a condo because we were hoping to have a more permanent place to stay. It was difficult to find an apartment or house that would accept us because of my brother’s condition. Unfortunately, my brother passed away in 2025.
Even after that, I continued with the condo and the BPI bank amortization. Looking back, I realize that I was already financially stretched, but I kept trying to handle everything myself.

Fast forward to today, my credit card debts have accumulated to around ₱5M–₱6M, on top of my BPI home loan and personal loan. I’ve reached the point where I can no longer continue the tapal system, and I’m seriously considering letting my credit card accounts become overdue in the coming months.
I’m also trying to be responsible about my condo. I’m currently looking for a buyer, but I’m worried about what happens if I can’t find one and the property eventually gets foreclosed.

My biggest question is: if my condo is foreclosed and there is still a deficiency after the foreclosure sale, can I be imprisoned because I cannot pay it?

I’m not trying to run away from my responsibilities. I know that some of my financial decisions contributed to where I am today, and I want to take responsibility for them. I genuinely want to understand my options and deal with this properly. I’m just at a point where I don’t know how to get out of this situation anymore.
To be completely honest, I’ve been crying almost every night and have been having thoughts of suicide because the financial pressure feels overwhelming. But I’m still holding on to my faith in God and hoping that somehow, I’ll get through this.

If anyone has been in a similar situation, especially with credit card debt, home loan foreclosure, deficiency balances, or negotiating with banks, I would really appreciate hearing your experiences and advice.

Please be kind. I’m already struggling, but I genuinely want to take responsibility and find a way forward.
