Do I actually have the right to look at my employee file? (Looking for advice/general rules)
Hey everyone,
Quick question for anyone familiar with HR or employment stuff—do employees generally have a legal right to see what’s inside their own personnel/employee file?
I’ve been thinking about asking to look at mine just to see what’s in there (performance reviews, notes, disciplinary history, etc.), but I wanted to know what the rules actually are. Does HR have to show it to you if you ask, or can they legally say no?
If anyone has dealt with this or knows how it works (especially regarding privacy laws or standard company policies), I’d love to hear your thoughts or experiences!
Note;- I want/need to see it because I've been sitting in limbo for 7 months after an investigation with zero outcome given to me. On top of that, an official third party requested details from my employer a month ago regarding this, and my employer is completely ghosting them.
As a nurse, having an unresolved investigation hanging over your head indefinitely affects professional standing and peace of mind. I'm just trying to figure out what is actually being documented (or stalled) in my file since management refuses to communicate.
