How do sellers of fanmade merch handle copyright/legality issues?

I want to make and sell (kpop group) BoyNextDoor-related fanmade merch (photocards, keychains, etc.) featuring the group. I know sellers do this all the time in the fandom space, but I'm trying to understand the legal side.

  • Is it actually legal to sell fan-made merch that uses a group's likeness/branding?
  • Is there a gray area if the designs are original artwork of mine, just inspired by the group (rather than using official photos/logos)?
  • How do existing fanmade sellers get away with it, is it more "companies tolerate it" than "it's technically legal"?
