§14 StAG before 1949
Hi everyone,
I am trying to better understand my eligibility for German citizenship through §14 StAG / the 30 August 2019 decree concerning descendants affected by historical gender discrimination before the Basic Law came into force.
My family line is:
- German male ancestor, born in Germany in 1888. He emigrated to Brazil in 1913 and never naturalized as Brazilian.
- His daughter was born in Brazil in 1928. Her parents were married, so she appears to have acquired German citizenship through her German father.
- She married a Brazilian citizen in 1945 and, under the law applicable at the time, lost her German citizenship through marriage to a foreign man.
- Their daughter was born on 20 August 1947.
- Her son was born in 1968.
- I was born in Brazil in 2001.
Because the affected descendant was born before 24 May 1949, I understand that §5 StAG does not apply to our line and that the possible route is facilitated naturalization under §14 StAG in conjunction with the 2019 decree, section 3.1.1.
I have already contacted the BVA. They confirmed to me in writing that the B1 language requirement may be submitted later during the procedure without disadvantage, and that B1 certificates from ALTE full-member institutions may be accepted. They specifically mentioned TestDaF, ÖSD, Goethe, telc and AFU, as well as DSH, KMK certificates and other equivalent language diplomas. They also stated that the exam may be taken online under the applicable conditions.
The BVA then told me that the application should be submitted through the German mission responsible for my place of residence, which will review the documents and forward the application to the BVA together with a statement.
My main questions are:
- Has anyone here successfully completed a §14 / pre-1949 gender discrimination case recently?
- Was there a personal interview or appointment at the German consulate? If so, what exactly was assessed?
- Did you have to take an Einbürgerungstest in addition to B1? If yes, how was this arranged for someone living outside Germany?
- Has anyone successfully used an online B1 exam or a certificate other than Goethe/telc for this exact §14 route?
- Has anyone submitted the §14 application before obtaining B1 and provided the certificate later?
- I have seen reports that some pre-1949 §14/Müttererlass cases may have been delayed or held while the BVA/BMI reviews the treatment of these cases. Has anyone received any recent official correspondence or decision about this?
- Is anyone aware of any serious administrative or legislative discussion that could eventually extend §5 StAG to people affected before 24 May 1949, instead of requiring §14 naturalization?
I am especially interested in experiences from people with a similar family structure: German woman who lost citizenship by marrying a foreigner before 1949, child born before 24 May 1949, and later descendants living abroad.
Any recent BVA correspondence, personal experience, official source or case reference would be very helpful.
Thank you!
