We just received our second denial. My husband is incarcerated and was unable to attend the interview so USCIS denied the petition for abandonment even though I attended the interview. my husband is a US citizen. I have spoken to a number of attorneys Three of them have told me that there is no legal way forward for this case One of them suggested that I file an i-130 and select consular processing and hopes that the i-130 gets approved before I get put into removal proceedings? urgently looking forward advice.
