Penny Wong condemns Israeli minister over ‘shocking and unacceptable’ treatment of flotilla activists

Australia’s foreign affairs minister, Penny Wong, has condemned the actions of a far-right Israeli minister who posted a video of himself abusing bound activists captured while trying to sail an aid flotilla to Gaza.

In the video, dozens of men and women are seen kneeling in rows, with their foreheads to the ground and their hands zip-tied behind their back.

Among the flotilla detainees are 11 Australian activists who were taken into custody by Israeli forces off the coast of Cyprus earlier this week, but it is not known if they were present in Ben-Gvir’s video.

Donald Rothwell, a professor of international law at the Australian National University, raised concerns about Israel’s actions. He said while a naval blockade is a legitimate naval warfare act during an armed conflict, there was “no legal basis under international law” for Israel to enforce its blockade off the coast of Cyprus. He said this was because there was no international armed conflict between Israel and Palestine, despite Israel’s position that a blockade was legitimate due to the threat posed by Hamas.

This is a problem because it is depriving Australians of a nutritious, cheap and local food source.

Pianist Jayson Gillham’s case against MSO mustn’t turn into ‘roving inquiry’ on Middle East conflict, judge warns

Pianist Jayson Gillham is suing the MSO over a cancelled Melbourne concert he was contracted to perform on 15 August 2024, a cancellation which he claims was an attempt to silence him over his stance on the Gaza conflict.

Gillham’s barrister, Sheryn Omeri KC, said in her opening submission that there was nothing in the MSO contract that prevented Gillham from making the statement.

The statement was his genuinely held political belief, and nothing about it would have had such an effect on the audience that the MSO was warranted in cancelling the future performance.

She said Gillham was applauded after performing Witness – despite claims from MSO that it was not well-received – and no audience member raised concerns with him about his introduction when he spoke with them and signed CDs after the performance.

“There is a difference between feeling uncomfortable and feeling unsafe,” Omeri said.

“Nothing in Mr Gillham’s introduction to Witness could or would have made anybody feel unsafe in the true sense of that term.”

Four aspiring political parties seeking to contest the Victorian state election – including a new website called “Refugees Are Welcome Here” – could be a part of a “connected campaign” to funnel preferences to One Nation and other conservative parties.

The website for “Refugees Are Welcome Here”, created on 5 May, said it’s seeking 750 Victorian members to sign up so it can register as a political party in the state.

The domain is being hosted on the same IP address as the so-called “Muslim Votes Matter” party, the “Free Palestine party” and the “Save the Environment party” – three other entities seeking registration ahead of the November’s election. Their websites similarly ask for 750 members to sign up, although the Victorian Electoral Commission requires only 500.

NSW Police can avoid transpatency and accountability by gagging the police oversight organisation from releasing evidence.

NSW Police Commissioner can declare any evidence provided police as “police business”, banning the Law Enforcement Conduct Commission (LECC) from disclosing it:

> Under the process, the Police Commissioner can issue the LECC with secrecy notices, stating information must remain secret, and can cite a range of reasons, including if it is in the “public interest”, which is not defined.

What the word intifada means to Australian Jews and whether it offends will determine the outcome of a landmark case against two Sydney academics for their social media posts about the Israeli-Palestinian conflict, the Federal Court heard on Tuesday.

Dr Nick Riemer, a linguistics expert, and Professor John Keane, a political scientist, are being sued over a series of posts to X, formerly Twitter, in a case that will test the nation’s hate speech laws.

The duo maintain that they were criticising Zionism, which they purport is not antisemitic.

The group of Jewish academics suing the pair is also taking action against their employer, The University of Sydney, saying it is vicariously responsible for the statements.

In the Keane matter, the applicants claim the presence of Hamas flags on his X page on October 8, 2023, suggested Keane “celebrated, endorsed, supported and approved” the organisation’s terrorist attack on Israel the day before.

In the Riemer matter, the applicants claim posts on X, speeches and Riemer’s participation in a chant “Israel out of Gaza, Israel out of Palestine, long live the intifada” imputes “intifadas should extend to a violent global uprising against Jews and Israelis in Australia and other parts of the world in support of the Palestinian resistance” and the events of October 7, 2023, should be celebrated.

A packed courtroom inside Sydney’s Federal Court booed, jeered and cheered at various points throughout the day-long hearing about the case’s scope on Tuesday at which the Federal Court’s Justice Geoffrey Kennett said he has a “fear of this case becoming another royal commission into antisemitism”.

Barrister Jessie Taylor, appearing for Riemer and Keane, said the hearing would not become another royal commission and the case was limited to whether a reasonable person would be offended by the posts.

Adam Butt, appearing for the Jewish academics, said it is “entirely irrelevant” what Riemer and Keane believe is meant by the term intifada. Related Article AUJS’ Liat Grenot says there is a fear around disclosing Jewish identity and “It’s just impossible to tell what someone’s reaction will be.”

“The only fight about what intifada means is what it means to Jewish people or Israeli people in Australia. The other side of the history and this conflict is entirely irrelevant. My clients are not being sued for vilifying Palestinians or any other people. The substantial Jewish perspective is what matters,” he said.

Keane and Riemer have raised more than $173,000 for legal fees in what they say is a critical moment for free speech.

In court on Tuesday, Butt said: “This is not about what Hamas intended, this is about what Jews and Israelis believe.”

Riemer will organise a symposium next month on what he calls the national crisis of repression at universities that “will explore the authoritarian institutional responses to Israel’s genocide from Australia’s universities”.

The case continues.
