Overseas trademark

their is a potential name i want for my company. On the US trademark database its dead/abandoned. And the owner/person who files is from china. So more than likely they could potentially have this name trade marked in China. If true how does that work with overseas marketing and business. As i want to start a entertainment company so that means selling merch etc .

This is getting far ahead i know ...but i just like to know how things work.

Abandoned trade mark?

Theres a name that i have for a company. The trade mark is dead/abandoned. Is their any problems that could come with using it? Like extra precautions. I plan on this name my brand and i would hate to spend time building it to.have problems later.

I want to file in for 16, 25,41, and 9.

There is another name i like however there is a company that has very simliar spelling just off by one letter how ever we both would you the same alternate spelling of the word electric. But their trademark is only for furniture class 20. Any problems here? They have a live trademark

Is this True with trademarks?

I was asking chatgpt some questions and yes i know to talk to a lawyer but free advice the best advice for the planning phase. But it made me aware of something i didnt know

So lets say in i Texas. I have all social media handle for my company. And potential a website. And lets i build a stable audience where i now fall under common law protection. But i dont have a trade mark.

Someone in Maine looking to start a business. Comes across my account likes my name checks if i have a trade mark and sees that i dont. They trade mark it right.

From what chatgpt was saying is that they could potiental have my social media platform amd websites taken away from me because they technially own the brand name.

My only defense would be common law bit according to chatgpt. It only protectse me in texas. And the person and maine can sell in all 49 states exept texas. Meaning i would be trapped from growing my buisness.

HOW DO YOU PROTECT YOURSELF WITH SPENDING THOUSANDS JUST STARTING OUT.

Then i was looking into unique mad up words trade marks i wanto class 16,24 and later on class 41

Lets my company is made up word.Qooaphoo [just example] i file class 16. Since its so unique can that protect me from other peopl filing a namewith that since its so unique. Where i would only need to file a word mark for that.

FILING A Trademark protecting you in other classes?

Trademarks are expensive per class and I was thinking of filing the class 16 and class twenty five as i'm just starting out and I don't want to spend a lot of money. However the overall idea for the business to grow is an entertainment business. ie go into film/tv productiom, games, animation and stuff.

Im starting with graphic novels and releasing them under tne company name. Ex [company name] Abc 123 wrtiten by blank .....etc.

Buy filing the class 16/25 trade mark can this protect me from some trying to file a class 41 trademark with the same name while im trying to build to get to filing a class 41myself ... As I can argue, customers may be confused with their production company as they may think.Their company are the creators of my clothing brand and graphic novels.The company name is unique 3 words and plus I have the handles on social media,

So lets say its TreeClockStone i file 16/25

Can someone years later file 41/9/42 in hopes using that name. Or what if they tried Treeclock.?

I have a name for a company.I already have the handle on every social media platform.And I was seeing that it's only ten to fifteen dollars to buy a website , so I just buy it and sit on it. CAN SOMEONE EXPLaiN HAVING A BUSINESS WITH OUT A LLC?

I have been doing some research about l.LC's and trademark stuff like that, where it's like you have to pay money per class you want to register in. So that cost around , like hundreds of dollars to do and then to actually file the l l c from my understanding , you have to pay eight hundred dollars annually , so that's around you , already paying thousands of dollars just to start a business.

So my question is for people that are like, I guess indie businesses on like social media that I see, like selling their books on TikTok shop or like selling their comics on their website are like, you know, YouTube or like gaming youtubers that sell merch and stuff. How do they set up their business?

My thing is I can purchase a website cause it's like it's cheap like 10 to $15 per year.That's fine.I can do that , but how do you keep your personal finances in your business finance separate without the LLC?\nIt's like, how do you protect yourself?If somebody buys a book and then pay like, Hey, I want to refund and then something happens or they sue you or whatever it is, right.How do you keep your personal finances and your business finance separate. How do you let's say I have a unique company name. I have the name already. Creating A Entertainment company the right name?

Guys i need help. So i have a plan, this is my first company ever , and I know how I want to scale forward. The big dream is to have a hand in what i like so film/tvproduction, gaming, animation, all under the brand name. However im staring off creating original stories in froms of graphic novels.

I DONT WANT TO BE KNOWN AS INDIE COMIC COMPANY.

Techically yes graphic can be comics but i just feel the comic label takes away what I want the audience to know my buisness as. The stories are standalone stories think of like robert kirkman's , the walking dead franchise , where it started off as a comic book , but it's like a story thas is an own world that spans over series of books. Standalone stories Where it's like a actual TV series, but in a graphic novel form. Example lets i have a storry called Foxbot i want to put it out. On the graphic novel it would look like

ABC presents [company brand name]

Foxbot

written by Jane doe

Artist by John do

I keep putting out stories like this next stand alone series blue sky same format then so on and so on and so on, as I start building an audience, so then the audience realizes like, oh, these stories are by ABC.

Does that work? I really want to stay away from the comic book label. Nothing wrong with it. But again, that's not the tone that I want for my company, because like I said, I do want to dive into those other mediums of film production, gaming and animation. If I'm lucky enough, the company grows.

Coming up with a name

So there's this name that I really, really like, and the only thing is, is that I've only found 2 companies that have similar names like one is not really a company that's more like has to do with like a new university.\n I guess it's like like an art wing of their university, but like I looked at the trademark thing, there's no filing under it. And then how I'm spellingvMine is off by two letters but I pronounce it differently.And mine is more going into, like the entertainment side of the business where there is from what I can tell.It's more so like like media like dance, art, digital media, stuff.It's in the entertainment's space.I guess but it's not really like it's own ll.C , it's more tied to the university. And then they're social media presence.I seen they had a YouTube and Instagram, but it's all under like a 100 followers.And like videos , from like 4 videos twenty five not like a views. And then there's the second company where it's off by 2 letters as well, but again, this company is more of like a manufacturing company. And then third, there's I found an artist that has the exact name that I want for my company. But again, this person is an artist and in music and pretty much unknown or underground, not much social media presence from I just I just seen the name when I googled it, but I looked up the On the u s trademark center , the only l llc that comes up is the manufacturing one. If I were to go with the name that I want cuz, it's pronounced differently. Cause my name is more focused on the entertainment like film TV. Video game podcasting side of it could I potentially get problems later on if I decide to use that name.

Script Previews

Does anyone have a script of a finished webtoon they were working on so i can see the format on how to script a webtoon. And see the finished version. Cause a couple of things i dont understand how its suppose to be written so an artist umderstands what you want.

Visual scripts?

So i want to start working on a story. I though abkut doing a webtoon as im more a visual story teller. Prose is not my thing at all. However im not really much of a comic book person as the only thing i ever read was captin underpants lol. But i just wanna out a story just to have something out out there as my 1st . But my biggest thing is i dont have the money to pay artist and a new to this whole thing of webtoons. My mind thinks in tv format like cut scenes. So I really want to create a webtoon , but the thing is , I cannot draw at all. And this is kind of more of a passion project , and im not trying to spend hundreds of dollars paying artist. I wohld like it to be more of a collab but anyway. How do i go about starting. Because my thing is , I have all these ideas and cool stories in my head , just like how a bunch of people do that , I just want to see come to fruition. Cause i've seen like on web novel , some stories like lord of mystery , solo leveling , they blew up and were able to become like animated tv shows , which is essentially my end goal is to create something that helps me get into the business of t v production , creating shows and animated movies. However, cause I thought about riding a web novel and just putting it out there to hope and see like maybe it blows up.And then maybe gets adapted into a show but i'm not a big book person , and I don't like reading , so I'll try webtoons, because a lot of my stories are more visual , but the biggest thing THE BIGGEST THING I HAVE ISSUES WITH IS THIS

I seen some people say that if it's your first webtoon, it shouldn't be like your most favorite idea or like franchise type story, it should be something simple.However , every time I try to think of like a simple story to tell , i'm not really as invested in it as more of like the stories that have more of like series arks to it. And it's like , every time I try to come up with something simple I can't do it , and I end up turning it into more of like a like a series t v show than the web toon. It would help if there was like a app or something where you can just like, write a script and upload a script of your story.And then people created that way , from. But I've seen like some web tunes that are getting adapted to, like shows like school bus graveyard.I've seen us getting adopted, which are really enjoyed.But it's like for me , like i'm thinking more like owning I p original franchise storytelling like the story I have in my head is kind of like it's own universe , essentially , but it's like , is it too big to put on web too , especially for it to be my first project.
