My app got more attention than I thought

Early this year, I built a privacy-focused document scanner and management tool for myself. It is free with no ads.  It’s offline-first, with optional features to back up your scans to Google Drive, iCloud, Paperless-ng, and Nextcloud.

The idea was born out of my dealing with paper documents, business cards, and having a digital copy of my driver's license without needing to purchase a scanner.  I didn't build it with the intention of starting something up, but to solve my own problem. It’s great to see other people using it, which I only discovered last week by looking at App Store data. I decided to check my email and waitlist, and there have been requests about when the Android version will land.

My idea for Keeplys was a simple document-scanning app. Scan the doc, stash it away, sync wherever I want without being locked in. I initially supported automatic syncing with iCloud, Google Drive, and Paperless-NGX.

I built it for myself. But it's great to see other people using it as well.

New rule around tenant self-disclosure and Data collection of tenant information in 3 stages

For private landlords wanting to rent an apartment, please note that in March 2026 the German Datenschutzkonferenz (DSK) issued an updated Orientierungshilfe that fundamentally changes when you can collect which data. 

When I was applying for apartments 7 years ago, I was advised to bring my payslip and a bunch of personal documents to the viewing appointment and submit them accordingly. The new ordinance from this year introduced 3 phases.

Phase 1: At the viewing (Besichtigung)

You may collect only:

  • Full name
  • Contact data (phone, email)
  • Possibly the number of people moving in.

Phase 2: Concrete intent / pre-contractual phase

Once the applicant has signalled serious interest and you are seriously considering them, you may collect:

  • Income (Nettoeinkommen)
  • Employer and employment type
  • Schufa-BonitätsCheck
  • Insolvency declaration
  • Pets, intended use

Phase 3: Just before contract signing

Only at this final stage may you request:

  • Mietschuldenfreiheitsbescheinigung (certificate of no rent debts)
  • Last 3 payslips (Gehaltsabrechnungen)
  • Employer confirmation
  • Identity verification by visual inspection

This staged approach is meant to enforce data minimisation under Art. 5(1)(c) DSGVO. 

NB: I don’t know any penalty for violation at this point, but it might be worth knowing.

Verkehrssicherungspflicht: The Civil Liability Duty Most German Landlords Forget

The Verkehrssicherungspflicht is the duty of traffic safety on your property. If you own a house or multifamily house, you have a duty to maintain traffic safety on your property. This is built from § 823 BGB (general civil liability), § 836 BGB (specific building-owner liability), and decades of case law that defines what a “reasonable” property owner must do to prevent foreseeable harm. Most landlords do not think about this duty until something happens. By then, the question is no longer whether they had the duty but whether they fulfilled it.

  1. A tenant slips on an icy stairwell and breaks a hip.
  2. A passerby is hit by a roof tile in a storm.
  3. A child falls from a corroded swing in the building’s playground.
  4. A neighbor's car is crushed by a branch from your tree

Each of these scenarios ends the same way: the injured party sues the property owner under § 823 BGB, and the damages can run into five or six figures. A property owner must take reasonable, foreseeable, and economically proportionate measures to prevent harm to anyone lawfully on or near the property. Failure to do so means damages, often plus pain and suffering (Schmerzensgeld), often plus future loss of earnings.

Wohnungsübergabeprotokoll: How to Run a Legally Bulletproof Handover

Rookie mistakes I often see people make when buying a tenanted apartment: Wohnungsübergabeprotokoll. Don't make it; it could cost you money.

The Wohnungsübergabeprotokoll is arguably the most undervalued document in residential property management.
It’s even more important if you’re buying a tenanted apartment. I have made this mistake myself, where I didn’t request a Wohnungsübergabeprotokoll after a purchase. The consequence only became clear later: when that tenant eventually moved out, I had no documented baseline of the apartment's condition at move-in — and that baseline is precisely what you need to assert a claim against the deposit. Without it, you are largely defenseless.

Note that there is no German statute that requires you to make one. Yet almost every dispute over a security deposit, a damage claim, or a Schönheitsreparaturen argument is decided by reference to this piece of paper, or by the absence of it.

The April 2025 ruling tightened this further: a jointly signed protocol confirming that the unit is “free of defects” at handover is binding. Neither party can later raise an item that was visible at the time and not listed in the protocol.

Two consequences from this:

  • For a landlord, anything you notice at move-out that was not documented at move-in is generally presumed to be pre-existing wear, not tenant damage. You cannot deduct for it from the Mietkaution.
  • For a tenant, any defect they raise after move-in that they should have noticed at handover is presumed to have been accepted. They cannot rely on it later to reduce rent or claim repairs (with the hidden-defect exception below).
  • The same logic runs in reverse at move-out: defects you spot and log become the basis for deposit deductions; defects you do not log cannot be claimed.

The following are the minimum contents that a Wohnungsübergabeprotokoll should have:

  • Date and time of the handover, address, full name of parties present
  • All meter readings
  • Keys handed overs and how many, garage, balcony, building floor, cellar, attic, etc.
  • Detailed room-by-room conditions
  • Defect logs
  • Signature of both parties with date.

 

If you are buying an apartment with a sitting tenant, ensure you request Wohnungsübergabeprotokoll to understand the state and the condition of the apartment when the sitting tenant moved in.

Handling tenant security deposits and what is legally allowed.

Many landlords, especially expats, are often unsure about the correct way to handle security deposits. Here are the most important things to keep in mind:

  • The maximum deposit allowed is three months of cold rent (Nettokaltmiete). If you demand more, it’s illegal
  • The tenant has the legal right under § 551 Abs. 2 BGB to split the deposit into three equal monthly installments. The first is due at move-in, the second one month later, the third the month after that. You cannot demand the whole amount upfront if the tenant invokes this right.
  • Any clause in the lease asking for more than three months is automatically void to the extent of the excess. The tenant is entitled to refund the surplus with interest, even mid-tenancy.
  • § 551 Abs. 3 BGB requires that the deposit be held separately from your own assets, at a credit institution, in an account that bears at least the standard interest rate for savings deposits with three-month notice.
  • You are obligated to:
    • Hold the deposit in an account that earns at least the standard rate for three-month-notice savings.
    • Document the interest accrued.
    • Pay it out together with the principal when the tenancy ends and no withholdings apply.
  • There is no statutory deadline for returning the deposit. § 551 BGB regulates the amount and the holding form, not the timing. The legal test is whether you have a “secured claim” (gesichert) against the tenant’s deposit. If not, you must release.

153 users one month after launch

This still feels a bit surreal.

Earlier this year, I decided to build my own property management tool, vermietler.com, after dealing with one too many frustrating experiences with traditional management services.

A month after launching, we’ve crossed 100+ monthly active users.

Honestly, I didn’t expect this so soon. It’s been motivating to see that the problem is more common than I thought and that there’s still a real gap in the market despite what people often say.

There are a lot of hurdles to cross, and I don't yet ma money with this. But this is enough to keep me going. If you want to try it out and provide feedback, that would be highly appreciated.

The German Bundestag has approved the further digitalization of real estate transactions. From 2027, contracts for the purchase and sale of land must be processed entirely electronically.

Green light for the further digitalization of real estate transactions: On May 7, 2026, the German Bundestag passed a law requiring that contracts for the purchase and sale of land be processed completely digitally from next year. 

If the Federal Council approves the new regulation, all documents and information between notaries, courts and authorities must be exchanged electronically after a real estate contract has been notarized.

1. Short-term rentals clarified
Temporary rental contracts will generally be limited to 6 months, with a one-time extension up to 8 months if justified. Longer stays would automatically trigger full tenant protections, including rent control.

2. Furnished apartment surcharges regulated
Landlords in high-demand areas must clearly disclose any furniture surcharge. The surcharge must reflect the current value of the furniture and remain reasonable.
For fully furnished apartments, a simplified 10% of net cold rent may be used. If no disclosure is made, the unit is legally treated as unfurnished.

3. Index-linked rents capped
In tight housing markets, annual rent increases under index leases will be partially limited. If inflation exceeds 3%, only half of the excess may be passed on.

4. Grace-period payments expanded
Tenants who fall behind on rent may now avoid not only immediate termination but also ordinary termination—once—if they pay outstanding arrears.

5. Simplified modernization cost allocation expanded
The threshold for simplified rent increases due to modernization rises from €10,000 to €20,000, making it easier for small landlords to recover renovation costs.

6. Additional measures

  • Stronger tenant rights for document inspection
  • Digital delivery of cost records in commercial leases
  • Expanded protections under the principle “Kauf bricht nicht Miete”
  • Better rules for rent index data collection

2026 entwickelt sich zum Jahr mit den meisten gesetzlichen Neuerungen seit langem. Ich habe kürzlich über die Gesetze zu intelligenten Stromzählern geschrieben und nun beschlossen, alles zusammenzufassen, was entweder bereits in Kraft ist, dieses Jahr in Kraft tritt oder gerade ausgearbeitet wird. Damit erspare ich euch die mühsame Suche.

Verschärfung der Mietvorschriften:

  • Mietpreisbremse bis 2029 verlängert (max. 10 % über dem Mietspiegel in angespannten Märkten)
  • Indexmieten in angespannten Märkten auf 3,5 % pro Jahr begrenzt, Überschüsse verfallen endgültig und werden nicht aufgeschoben. Eine Mieterhöhung um 15 % ist nicht möglich.
  • Möbelzuschlag auf 5 % der Kaltmiete begrenzt, muss einzeln aufgeführt werden, sonst darf er gar nicht berechnet werden
  • „Befristete“ Mietverträge auf insgesamt 6 Monate begrenzt, die Lücke mit dem rollierenden 12-Monats-Zeitraum ist geschlossen
  • Schonfrist: Mieter können eine Kündigung wegen Mietrückständen nun nur noch einmal anfechten

Energie & CO2 werden teuer:

  • Der CO2-Preis steigt auf 55–65 €/Tonne. Nach dem CO2KostAufG müssen Sie, wenn Ihr Gebäude der Klasse E oder schlechter angehört, 50–95 % der CO2-Kosten selbst tragen (das könnten 200–600 €/Jahr pro Einheit sein, die Sie nicht weitergeben können)
  • Neuer EU-Energieausweis (Skala A–G) ab Mai 2026. Entscheidend: Er ist nun auch bei Mietvertragsverlängerungen vorgeschrieben, nicht nur bei Neuvermietungen oder Verkäufen. Kosten: 300–500 € pro Zertifikat
  • Heizkosten müssen nach tatsächlichem Verbrauch abgerechnet werden, sonst können Mieter ihren Anteil um 15 % kürzen

Heizungsanlagen in der Schwebe:

  • Großstädte (>100.000 Einwohner) müssen bis zum 30. Juni 2026 Wärmeversorgungspläne veröffentlichen. Nach der Veröffentlichung gilt für alle neuen Heizungsanlagen in diesem Gebiet die 65-Prozent-Regel für erneuerbare Energien.
  • ABER das neue Gebäudemodernisierungsgesetz (das die GEG zum 1. Juli 2026 ablöst) soll die 65-Prozent-Regel vollständig abschaffen. Kurzfristig mehr Flexibilität, aber es wird erwartet, dass die Beschränkungen für fossile Brennstoffe bis 2029 wieder eingeführt werden. Gesetz noch anhängig

Grundsteuer & Messung:

  • Erstes volles Abrechnungsjahr der Grundsteuerreform. Das Gericht wies alle Einsprüche zurück. Rechnungen in städtischen Gebieten gestiegen, in einigen ländlichen Gebieten gesunken. Für Mieter weiterhin vollständig umlegbar
  • Intelligente Zähler und fernauslesbare Heizungszähler bis Ende 2026 verpflichtend. Anschaffungskosten gehen zu Lasten der Vermieter. Gemietete Zähler = als Betriebskosten umlegbar
  • Umwandlungsverbot (Verbot der Umwandlung von Mietwohnungen in Eigentumswohnungen) bis 2030 verlängert

Das ist die Frist der Heizkostenverordnung. Und wenn Sie als privater Vermieter Heizkosten immer noch zu 100 % nach Wohnfläche abrechnen, verstoßen Sie bereits gegen geltendes Recht.

Die Kürzungsrechte des Mieters sind kumulativ:

  • Keine verbrauchsabhängige Heizkostenabrechnung: 15 % Kürzung
  • Keine fernablesbaren Messgeräte: weitere 3 %
  • Keine monatliche Verbrauchsinformation: weitere 3 %

Das sind bis zu 21 % der Heizkosten Ihres Mieters, die Sie nicht einfordern können. Bei 2.000 €/Jahr Heizkosten sind das 420 €/Jahr, die Ihnen entgehen.

Was die Heizkostenverordnung tatsächlich verlangt:

  • 50 bis 70 % der Heiz-/Warmwasserkosten müssen nach gemessenem Verbrauch abgerechnet werden
  • 30 bis 50 % als Grundkosten nach Wohnfläche
  • Monatliche Verbrauchsinformation an Mieter (seit Januar 2022, wenn fernablesbare Zähler vorhanden)
  • Alle Zähler müssen bis 31. Dezember 2026 fernablesbar sein

Und Heizkosten sind nur eine Kostenart. Vielen Vermietern ist nicht bewusst, dass sie in derselben Nebenkostenabrechnung verschiedene Verteilerschlüssel für verschiedene Kostenpositionen verwenden können und sollten:

  • Wohnfläche für Grundsteuer und Versicherung
  • Personenzahl für Müllabfuhr (wenn im Mietvertrag vereinbart)
  • Verbrauch für Wasser (bei vorhandenen Einzelzählern)
  • Die vorgeschriebene HeizkV-Aufteilung für Heizung

Den falschen Schlüssel verwenden oder ihn in der Abrechnung nicht angeben, macht die gesamte Abrechnung formell unwirksam (BGH VIII ZR 84/07). Sie verlieren den Nachzahlungsanspruch, selbst wenn jeder Euro stimmt.

Zwei weitere Regeln, die die meisten Vermieter falsch machen:

  1. Es muss die tatsächlich gemessene Wohnfläche verwendet werden, nicht die Mietvertragsangabe. Der BGH hat die 10%-Toleranz für Betriebskosten 2018 abgeschafft.
  2. Leerstandskosten tragen Sie als Vermieter. Eine Umlage auf die verbleibenden Mieter ist unzulässig.

Wenn Sie Ihre Nebenkostenabrechnung selbst erstellen: Prüfen Sie Ihre Zähler, prüfen Sie Ihre Schlüssel, prüfen Sie Ihre Fristen. Der 31. Dezember 2026 ist näher, als es sich anfühlt.

The EU is rolling out the revised Energy Performance of Buildings Directive. Germany will transpose it via the new Gebäudemodernisierungsgesetz (GMG) on 1 July 2026.

What changes for new certificates:

  1. Unified A to G scale. Class A is reserved for zero-emission buildings. Class G covers the worst 15% of the national stock.
  2. CO2 emissions must appear on every certificate, alongside kWh/m². Climate impact becomes directly comparable between properties.
  3. Concrete renovation recommendations are mandatory. Vague advice no longer qualifies.
  4. New trigger events. Contract renewals and renovations above 25% of the envelope now require a valid certificate, not just new tenancies and sales.
  5. Only certified Energieeffizienz-Experten with on-site inspection. Remote photo-based certificates are out.

What landlords need to know:

  • Existing certificates stay valid for their full 10 years.
  • Fines for non-compliance remain up to €10,000.
  • EU MEPS target the worst 16% of buildings for Class F by 2030 and the worst 26% for Class E by 2033.
  • If your property sits in today's Class G or H, plan renovations now, not in 2029.

The most overlooked change is the contract renewal trigger. Many landlords assume the Energieausweis only matters at new lettings. From May 2026, renewing an existing tenant's contract is enough to activate the obligation.
