Complex H1B/H4 EAD Timeline: Need advice on maintaining employment (PERM pending, Max-out approaching, LOA, & WOM)
Hi everyone, I am in a very unique and time-sensitive situation regarding my H1B max-out, a pending H4+EAD, and an upcoming H1B extension based on a pending PERM. I want to keep my stable job and avoid any gap in employment. I would love your insights on my best options.
My Current Status & Timeline:
H1B Max-Out: I have used up almost all of my 6 years on H1B. I only have 22 days remaining (plus about 26 days of vacation/recapture time that I can claim).
PERM Status: My PERM was filed in September 2025 and is currently in progress. By September 2026, it will hit the 365-day mark, making me eligible for a 1-year H1B extension.
Current Employment: I am currently on an approved Leave of Absence (LOA) with my company until September 2026.
Pending H4 / EAD (Standalone): I filed a standalone H4 change of status and EAD application back in January 2026. Both are still stuck in "Case Received" status.
Spouse’s Extension (Concurrent Filing): My spouse’s H1B extension was just filed via Premium Processing on June 30, 2026, along with my H4 and EAD extensions. We are currently waiting for the receipt notices.
My Goals & Questions for the Group:
- Claiming Recapture Time & the 1-Year Extension: What is the best strategy/timing to file an H1B extension to claim my remaining 22 days + 26 days of recapture time to keep me in employment status until my PERM hits the 365-day mark in September? Can my employer file this now?
- Writ of Mandamus (WOM): I am strongly considering filing a Writ of Mandamus this month (July) to push a decision on my January H4/EAD applications. If my employer also files an H1B extension for me in August, will the pending WOM or a potential H4 approval negatively impact or conflict with that H1B filing?
- H4 EAD vs. H1B Path: Given that my spouse's extension was filed in Premium Processing on June 30, is it safer to just wait for that H4/EAD approval, or should I actively pursue the H1B recapture/PERM extension path with my employer?
