Here’s why Ben’s Small Claims Case got Dismissed for Improper Service of Process - and Why it isn’t Bullshit

Lot of people in this sub seem confused about how the nuance of service process on an LLC works - it’s more complicated than for an individual

So as you can see in the first image, Ben listed “Bricks L2 LLC” as the defendant. Red text in the top left indicates the claim was dismissed due to improper service on “someone called ‘Caledonia’”.

Caledonia is the name of the young employee at the Salem location (Lego Queen). We can see them serving her here

The first issue is that Ben sued the wrong defendant. “Bricks L2 LLC” is not a real entity. He was meaning to name “L2 Bricks LLC”, who is listed as the registered agent for the entity “Bricks and Minifigs Store 36”. (See second image). Ben recognized that service must be made on the registered agent, and tried to do that. He simply targeted the wrong entity, as Bricks and Minifigs Store 36 went inactive in 2018 (there’s like 10-15 different versions of Bricks entities, it’s confusing). This is less relevant, but for the sake of clarity, the proper registered agent for L2 Bricks LLC is Matthew Bauman, so it still would not have been proper even if that was the correct entity (this entity was also dissolved in 2021).

The proper defendant is the entity “Salem-Baker Bricks Inc.” The registered agent for this entity is “United States Corporation Agents, Inc.” (see third image). Also in the image you can verify this is the correct entity, as it is registered under Brandon Best in November 2024 and was administratively dissolved January 15, 2026.

Now back to the service on Caledonia - even if we assume that all naming conventions were proper in his lawsuit, Caledonia is simply not a registered agent. Under Oregon law, serving process on an LLC requires delivery to A) the entity’s registered agent, or B) the Oregon Secretary of State. (see fourth image, also link here)

Yes, if it was based on common sense, service to Caledonia should be sufficient because obviously the people who need to know about it would get notice from Caledonia. However, that’s not how the law works - the recipient *must* be a registered agent (or the SOS as default registered agent)
