"MICHAEL" Sequel | The 1993 case settlement ⚖️🎥🎬

Earlier, I was finally able to find the settlement which hampered the biopic production and I’ve read it.
With the help of AI Gemini, I could get a better understanding of this clause and see how the biopic producers could handle this case in the movie.

I give you the retranscription of this specific part:

“Jackson, individually, and on behalf of his agents, heirs, administrators, executors, conservators, successors, assigns and Related Companies hereby agrees that they will not at any time in the future nake any engagement, enter into any contract, agreement, connitment, understanding or other obligation, with any media, including, without limitation, any publishing, print, news, television, motion picture, cable, video, multinedia, software, recording, broadcast, radio or any other media, for purposes of or relating to the commercial exploitation by Jackson or any Related Companies or his attorneys of record in the Action of any story, documentary, docudrama, publication, magazine, tabloid, book, article, motion picture, television program or picture, "movie-of-the-week", serial, miniseries, recording, record, audiotape, compact disc, videotape, program, television or other public or private appearance, interview or broadcast, related to the Minor or in any capacity, any recreation or likeness of the Miner or or their image, Jackson's relationship with the Minor. The allegations made in the Action, any information Ievealed through discovery in the Action, or the clains. In addition to any other legal or equitable remedy as may be available as a result of any breach of this paragraph, the Parties acknowledge that the Minor or their respective heirs, administrators, executors, conservators, successors and assigns, shall be entitled to recoup as recovery for unjust enrichment, or any other applicable cause of action, any suns as may be received by the breaching party as compensation for such comercial exploitation.”

Here’s the direction that the sequel has to take:

What the Film CANNOT Do (The Red Line) 🚫

- No representation of the accuser or his family: The contract strictly prohibits any "recreation or likeness" of the Chandler family. No actors will play the roles of Jordan or his father. They will remain completely invisible on screen, and the studio cannot even create fictional characters whose storylines might "resemble" theirs.

- No portrayal of the relationship with the minor: The film is absolutely not allowed to bring the friendship between Michael and Jordan to the screen. The film cannot directly attack the legitimacy or intentions of the plaintiffs on screen, forcing the narrative to focus solely on the relentless persecution by the media and law enforcement.

- No mention of the financial settlement or the clause: The strict confidentiality clause of this 1994 contract prohibits disclosing its terms, the negotiations, or the monetary amount (the $23 million settlement). Consequently, the film cannot feature any scenes of the attorneys negotiating this agreement, nor even mention on screen that an out-of-court settlement took place to close the civil case.

What the Film CAN Show (The Creative Freedom)

- The police search (The Criminal Case): The private settlement does not erase the public actions of the state. The film has the right to show the police raid on Neverland in August 1993, the search warrants, and to dramatize District Attorney Tom Sneddon's media and judicial obsession.

- The December 1993 televised statement: This is the production's ultimate legal workaround. Because this globally broadcast speech aired before the contract was signed, it belongs to public history. Actor Jaafar Jackson will be able to recreate this address word for word. It is through this legal loophole that the film will be able to show Michael asserting his innocence and publicly denouncing the humiliating police strip search.

- The "Media War": The contract does not prevent depicting the public destruction of a man. The film will emphasize the tabloid frenzy, the character-assassinating front pages, the news helicopters, and the hell of a life hunted 24/7 by the paparazzi.

- The professional and medical impact: The film will address the very tangible repercussions of this 1993 storm: the artist's exhaustion, the abrupt cancellation of the remainder of the Dangerous Tour, the crumbling of his commercial empire (loss of sponsorships), and the development of his addiction to painkillers that ultimately led him to rehab.
