F2A Submitted July 1st, 2022 - Current Status Still Processing
My Form I-130 was filed on July 1, 2022. Later, I concurrently filed my Form I-485 and Form I-765 on May 12, 2025. I received my Employment Authorization Document (EAD) on January 7, 2026.
I attended my adjustment of status interview in December 2025. During the interview, the officer appeared to misunderstand the regulations regarding F-1 students and Optional Practical Training (OPT). The officer stated that I was living and working in the United States illegally as an F-1 student. I respectfully disagreed and provided evidence that my SEVIS record and Form I-20 were valid and that I was maintaining my lawful F-1 status while on OPT.
The interview did not focus on the bona fides of my marriage or my relationship with my wife. Instead, most of the questions concerned my F-1 status, my legal presence in the United States, and how my wife obtained her green card, which I felt was unrelated to the purpose of the adjustment interview.
At the conclusion of the interview, I was instructed to go home and wait for a decision. On May 2, 2026, my case status updated from "Interview was Scheduled" back to "Case Is Still Being Processed by USCIS". Because my case had exceeded the normal processing time, I submitted an inquiry on May 18, 2026.
Since then, I have continued waiting without any clear information regarding my case. The uncertainty, combined with reports of potential policy changes affecting visa holders and students, has caused me significant stress, frustration, and instability in my personal life. At this point, I genuinely do not understand what is happening with my case and remain concerned about my future and immigration status.
