GST44 vs 221

Maybe I'm over thinking this but if an HST registered corporation is selling a commercial property, that they lease to businesses, to another HST registered Canadian corp., the buyer must self-assess the HST on the sale price and then gets to claim the corresponding ITC on the same return?

The part where I'm struggling is would this be considered a sale of a "business" which you could potentially make an argument for under the below and therefore file GST44:

I'm leaning to self assess but open to being wrong

60(j) transfer

For Canadian resident commuters to the US for work or for US citizens who are Canadian tax residents and work for a US employer who have 401(k)s or IRAs, what are there typical options upon retirement?

I'm asking because if you are a Canadian resident while contributing to a 401(k), you cannot transfer the 401(k) or IRA into your RRSP using 60(j). The only option it seems is:

  1. Leave it in the US as a 401k or IRA and take periodic payments

2)Pay the withholding tax on a lumpsum withdraw and move it to Canada using either only your RRSP room available or other non.reg. account

Am I correct in my thinking?
