Rear ended and third party denies liability UK insurance
hi all - I was rear ended whilst my vehicle was at a complete stop back in Feb. driver was on phone and wasnt looking, I couldn’t move forward as there was a car in front of me turning right. Third party immediately apologised, asked for my number and asked to settle out of insurance and to pay for my vehicle repairs. I had to go through insurance as my vehicle is a lease car at work. my insurer does not cover injury claims so I’ve had to chase the cost of some whiplash claims myself through the government portal (official injury claim) however despite submitting my evidence (images of rear end damage, him texting me apologising and admitting fault and trying to track me down to repair my car, images that show his version of events aren’t possible) they’ve denied liability each time and now I’ve got to proceed to court. He’s alleged I pulled out and he had to emergency brake to try and avoid me by swerving to right but he couldn’t. My damage to my vehicle is rear left and central and the garage who repaired my car have confirmed the damages are consistent from central rear impact but they continue to deny liability. I’ve been told this is normal and they’ll dig in all the way to the end but I’m so confused how they can even deny liability when he’s rear ended me? Am I likely to win this in court as they’ve only provided his statement as their evidence and nothing to counter my reports, images, GPS yet feeling very confused as representing myself
