August 19, 2026: Judge Limits What Government Gang Expert Can Say in Durk Case

Judge Fitzgerald ruled on Durk’s motion to stop the government’s gang expert, Chicago PD Detective Kevin Kilroy, from giving certain testimony.
Durk’s defense wanted Kilroy completely excluded, but the judge said NO to that. the motion was GRANTED in part and DENIED in part.
Kilroy can still testify, but only about certain things.
he can explain gang terms used in evidence, the practice of retaliation after a gang member is killed, some basic Black Disciples background when it’s needed to understand the case, and issues with getting phone records in gang related investigations.
the judge also said Kilroy is qualified to give this limited testimony because of his experience investigating gang related crimes in Chicago.
BUT Kilroy cannot talk about a lot of the other stuff the government wanted him to talk about. the judge excluded topics 2 through 7 from his disclosure. he also cannot give general information about the Gangster Disciples or talk about gang rivalries that have nothing to do with this case.
Kilroy also cannot personally say that Durk or the other defendants are members of a certain gang. he can talk about facts that the government may use to argue that, but he cannot give his own opinion saying they are gang members.
he also cannot testify about personally arresting Durk.
the judge also made it clear that gang evidence cannot become “the entire theme of the trial.” the jury will be questioned about possible bias toward gang evidence during voir dire and they will get instructions explaining how they are allowed to use the gang evidence.
the government also cannot call this “a gang related murder case.”
Durk’s defense will have Dr. Lance Williams as a rebuttal expert. he can only respond to the limited opinions Kilroy is allowed to give, and the government cannot use his testimony as a reason to bring back evidence the judge already excluded.
Durk also asked the judge to make a ruling on additional gang evidence from PW 1’s July 9 FBI interview. the judge denied that request WITHOUT PREJUDICE, meaning the defense can still object at trial if specific gang related testimony comes up. the same limits from this ruling will apply to fact witnesses too.
so basically, Durk did NOT get the gang expert completely thrown out, but the judge heavily limited what he can say and is taking steps to make sure the gang evidence does not take over the trial.
