Rental conditions
I'm trying to rent a home with a garden in Copenhagen (Hellerup) and the contract is based on the standard Lejekontrakt 10a, but in section 11 the landlord added some clauses, which I think are a bit over the top owner friendly. Can anyone confirm these are normal, or indeed too much from the landlord to ask for:
- It is agreed that the exterior maintenance of the rental property and associated outdoor areas is the responsibility of the tenant. The garden, outdoor areas, and exterior building parts must be kept in good and well-maintained condition. If the tenant does not fulfill this obligation within 8 days after being requested to do so by the landlord, the landlord may carry out the work at the tenant’s expense.
(Det aftales, at den udvendige vedligeholdelse af lejemålet samt tilhørende arealer påhviler lejeren. Have og udearealer samt udvendige bygningsdele skal fremstå i velpasset stand. Hvis lejeren ikke opfylder pligten inden 8 dage efter, at udlejeren har opfordret ham til det, kan udlejer istandsætte for lejerens regning.)
- The rental property will be newly painted upon move-in. The property will therefore appear with painted walls, painted woodwork, and floors without major scratches or marks. All paintable surfaces will appear freshly painted and without damage. All windows are intact, and appliances and installations are in good and usable condition. Upon move-out, the property must be returned in the same condition as when received and without damage. The tenant must vacate and hand over the property 14 calendar days before the tenancy ends to allow the landlord to carry out any necessary refurbishment. The tenant must provide the landlord with a new address and, upon moving out, return all sets of keys received when taking over the property. Failure to do so will require the tenant to cover the costs of rekeying/replacing locks and producing new keys. If the property after move-out is in a condition requiring refurbishment, the landlord is also entitled to claim reimbursement from the tenant for the associated costs. During the last six months of the tenancy, the landlord alone or together with third parties has the right, with three days’ notice, to inspect the inside of the property. The tenant must immediately notify the landlord if the tenant becomes aware of defects or damage to the property. The landlord and/or third parties have the right at any time, with three days’ notice, to access the interior of the property for inspection, repairs, or maintenance. The tenant must tolerate repairs or maintenance in the property without rent reduction unless the entire property is uninhabitable during the repair period.
(Lejemålet fremstår nymalet ved indflytningen. Lejemålet fremtræder således med malede vægge, malet træværk og gulve uden større ridser og mærker. Alle malbare flader fremstår nymalede og uden skader. Alle ruder er hele, og hårde hvidevarer og installationer er i god og brugbar stand. Ved fraflytning skal lejemålet afleveres i samme stand som ved modtagelsen og uden skader. Lejer skal fraflytte lejemålet og aflevere dette 14 kalenderdage før lejemålets ophør, med henblik på udlejers eventuelle istandsættelse. Lejeren skal meddele udlejer sin nye adresse, ligesom lejer ved fraflytning skal aflevere samtlige sæt nøgler, som lejer modtog ved overtagelsen af lejemålet. Sker dette ikke, skal lejer afholde udgifter til omstilling/udskiftning af låse og fremstilling af nye nøgler. Såfremt lejemålet efter fraflytning er i en stand, der nødvendiggør istandsættelse, er udlejer ligeledes berettiget til at kræve betaling fra lejeren for de udgifter, dette måtte medføre. Udlejer har alene eller sammen med tredjeparter i de sidste seks måneder af lejeperioden ret til med tre dages varsel at besigtige lejemålet indvendigt. Lejeren skal straks underrette udlejer hvis lejer bliver opmærksom på fejl eller skader på lejemålet. Udlejer og/eller tredjeparter har til enhver tid med tre dages varsel ret til adgang til lejemålet indvendigt med henblik på besigtigelse og udbedring af fejl eller vedligeholdelse. Lejeren skal uden lejereduktion tåle udbedring af fejl eller vedligeholdelse i lejemålet, medmindre hele lejemålet i udbedringsfasen er ubeboeligt.)
I feel like 1. we are of course happy to maintain the garden and outdoor areas properly and keep the property in good order. However, we cannot accept responsibility for structural or exterior building maintenance such as roofs, exterior walls, exterior paintwork, or similar items that would normally fall under landlord responsibility.
- Should we accept the requirement to vacate the property 14 calendar days before the end of the lease, while still paying rent for that period? We are of course willing to cooperate reasonably regarding inspections or necessary works, but if the property is to be vacated earlier for renovation purposes, we would expect a corresponding adjustment of the rent obligation.
There are some more things in the contract which feel overly owner friendly (like indexation of the rent that would start in august, already on january 1st next year). Maybe its normal in Copenhagen as so many people are looking for rentals.
TLDR: rental conditions seems overly owner friendly, looking for advice if this is normal.
