
Will i loose marks for writing less compared to the teachers on YouTube?
I was watching the 75 imp questions from PW anf the first question was decent but the answer? Isn't it way too long? Like a bit too much- is it normal to write these long answers in the paper?
I mean, if i were to get this question-
I'd give the explanation of doctrine of indoor management then proceed to counter each point in my words while obviously keeping it formal and using legal terms.
For example, this is how i would write the same answers if i was supposed to answer.
Under the provision of company's Act 2013, according to the doctrine of indoor management, outsiders are entitled to presume that all the internal procedure are duly compiled unless they have actual or constructive knowledge of irregularity. As the doctrine protects the outsider only against internal irregularities and not external acts beyond the company's authority.
i. The bank can claim protection under the doctrine of indoor management. Even though the bank didn't specify the borrowing amount, the bank was entitled to assume that board had internally determined through proper procedure.
ii. doctrine of indoor management provides exceptions in case of suspicion of irregularity, in which the provision doesn't reward those who are negligent of the transaction which is unusual or not in the ordinary course of business. The company's accountant transferring a valuable property without power of attorney to Mr.X and Mr.X accepting the transfer without proper enquiry regarding the accountant's authority disable him from claim for any protection under the doctrine of management.
iii. Forgery is a nullity and cannot be validated by assuming internal irregularities. Mr. Y cannot claim protection as the doctrine doesn't extend to external act of criminality or fraud.
Will i loose marks if i write this much only and not the one that this teacher is writing?
