Question about Dichiarazione di Non Rinuncia

I just emailed the NY consulate but they responded with their canned response (I get it - they're likely getting a lot more of these now) but didn't address the specific questions I had. I'll try to email again but in case I get the same response figured I'd ask here to see if anyone knew the answers.

  1. Their email says that I need: "signed and notarized request, legalized with Apostille, containing your email, the information that all the family members you are requesting the Consular declaration for used to live in NY and that the Consular declaration will be used in court"

Is there a certain format that this request needs to take? Just want to make sure I don't miss anything.

All of my ancestors lived in CT, not NY. However, the NY consulate has jurisdiction over CT. Are they still able to issue this for me and my ancestors or do I need to find somewhere else to request this?

  1. I am requesting this for two different people born in Italy - my great great grandmother and my great great grandfather (once in the US they married). Do I need a separate request and declaration for both of them or can it be done together?

  2. I am pursuing this court case with my first cousin. Are we and our moms both able to be included on one declaration or do we each need a separate one?

Is this sufficient proof that adopted child was born in Canada?

Hi Everyone,

I'm looking to complete my paperwork for citizenship by descent but I have a situation that I wanted to double check before I pay the money for a certified baptismal record from Quebec.

I am attempting to gain citizenship through my great-great grandfather who was born in Canada but then adopted (in Canada but by parents of Scottish descent who as far as I can tell were not Canadian). Essentially, I'm just wondering if the proof that I have is enough to verify his standing as Canadian or if the adoption makes anything more complicated.

I have his baptismal record which states: "name, the adopted child of father and mother, his wife, was born in Toronto, Western Canada, on the seventh day of March; one thousand eight hundred and sixty four; and was baptized on the twelfth day of June in the same year..."

It seems like this should be fairly clear that he was born in Canada but just wanted to double check. I believe his biological father was a Canadian citizen but I've been having trouble finding his records so would love to be able to move forward with this generation rather than one further back.
